The Tel Aviv District Attorney's Office (criminal) has filed an indictment in the city district court against 30-year-old Tommy Chela and 25-year-old David Blai from Rehovot for the murder of Moshe Elmihu at the entrance to a restaurant in Tel Aviv.

According to the indictment filed by Adv. Livnat Melamed, on February 5, in the early evening hours, the defendants and several friends arrived at a restaurant in the area.

At the same time as they arrived at the restaurant, Elmihu also arrived with his friends.

A few minutes later and during a random meeting between the defendants and Elmiah, an argument was discovered between Chelah and Elmiah, who refused to greet him.

Under these circumstances an argument developed between the two, during which Tzelha cursed the murdered man and threatened him "you will not get out of here today" (or words of similar meaning).

During the argument, Chela's friends tried to calm him down and even Elmiah tried to speak to his heart.

But Chelah ordered Elmiah to accompany him outside the restaurant "to talk outside and it would be all right."

Elmihu claimed that he was not interested in accompanying him so Chela grabbed his body and led them towards the exit of the restaurant, while wear and tear accompanied them.

The defendants led Elmiah to the exit and after trial, while Elmiah stood in front of them, signaled Tzelah with his head to wear, who pulled out a knife he had carried on his body ahead of time, and stabbed Elmiah six times, one of them in the heart, which led to his death.



In her request for detention until the end of the proceedings, Advocate Melamed said that “the respondents committed the act at the entrance to a crowded restaurant, on a Saturday evening, undisturbed, when the fear of the law does not apply to them, and do not fear the presence of others nearby.

Advocate Melamed added: "Moreover, immediately after the stabbing incident, Respondent 1 approached Elmiah's friends, and made it clear to them that their friend had been stabbed outside, and from there continued to sit down at the dining table.

Respondent 1's conduct as described above indicates a person who does not fear the law and is not afraid of the consequences of his conduct. "
