The Labour Department said today that, according to the Employment Ordinance, an employer cannot terminate an employee's employment contract while the employee is on paid sick leave, unless the employee is summarily dismissed due to gross negligence.

If an employer violates the relevant provisions of the Employment Ordinance, it is an offence and is liable to prosecution and, upon conviction, a maximum fine of $100,000.

In addition, if an employer violates the Employment Ordinance, it will be deemed ineligible to employ a foreign domestic helper for a period of time, and its application for a foreign domestic helper visa will be rejected.

According to the Employment Ordinance, employers should provide paid sick leave to foreign domestic helpers infected with the epidemic, and according to the "Standard Employment Contract", employers are required to provide foreign domestic helpers with free and suitable accommodation and free medical treatment.
