Federal Justice Minister Marco Buschmann has confirmed his plan to abolish the transsexual law that was introduced more than 40 years ago.
The FDP politician criticized the fact that those affected then had to go through a court procedure to change their gender entry, in which two expert opinions with the most intimate questions would be obtained.
He told the editorial network Germany (RND): “We have to have respect for these people and spare them this sometimes degrading treatment.
That is our goal.«
The traffic light parties had agreed in the coalition agreement to replace the transsexual law, which many trans people find humiliating, with a »self-determination law«.
"A staggering level of prejudice"
Buschmann emphasized that gender identity is part of the individual personality and is protected by personality rights.
That is the case law of the Federal Constitutional Court.
»So far, the applicable statutory law has not sufficiently taken this right of self-determination into account.«
Buschmann added: “I would also like to ask anyone who is not taking the matter really seriously to talk to people who find that they do not feel they belong to the gender entered in the birth register.” These went through difficult and stressful phases of identity and still encounter "a staggering level of prejudice" while the state treats them "as if something is wrong with them".
