A Miesbacher is accused of assaulting law enforcement officers and intentional bodily harm.

After a tragedy in which a man drowned in the Mangfall, a friend of the victim is now in the dock.

He is said to have attacked a police officer.

Miesbach – Actually, two should have been in the dock of the Miesbach District Court, but only one appeared.

The accusation against the 41-year-old Miesbacher: physical attack on law enforcement officers and intentional bodily harm.

At his birthday party in August 2021 at the Mangfall near Müller am Baum, he is said to have attacked a police officer, causing him to suffer a concussion.

A friend of the 41-year-old is said to have been involved in the scuffle.

At the heart of the altercation was a terrible tragedy.

At the birthday party, a friend of the accused fell into the Mangfall and drowned.

"He somehow slipped," stuttered the Miesbacher.

"We were almost all drunk." The drowned man's brother alerted the police and rescue workers.

"I wanted to look for my friend, but a police officer stopped me," the accused said, crying.

A scuffle ensued, and a second officer rushed in.

"Then we all fell on the floor," said the man from Miesbach.

"I guess I pushed the police officer somehow." In his opinion, the officer fell against a building.

He didn't realize that he was supposed to have passed out.

The day after the incident he was at the police station

to apologize to the officer.

But he spent the night in the hospital.

The accused wanted to look for the casualty

"Everyone in the group was in a state of emergency and drunk," reported the officer (26) from the Miesbach police, who also acted as an adhesion prosecutor, about the operation.

"I wanted to prevent him from looking for him because the current of the Mangfall was too strong." He grabbed the 41-year-old's shoulder when he tried to free himself.

"Then I felt a hit on the head from above," the police officer recalled.

In the further course of events, however, he had significant memory gaps.

“We were on the ground.

I pulled his head towards me.

We had to tie him up.

In the ambulance, they told me I collapsed," the police officer said.

What he still knows, "that I definitely didn't collapse from a nudge.

That was a solid hit.”

A colleague from the Holzkirchen Police Inspectorate also claims to have felt a blow to the head.

"I suffered a concussion," said the 32-year-old.

This must be related to the accused, he said, but added: "Unless someone says otherwise." He remembered the overall situation well.

Emergency doctor, helicopter, inflatable boats were in action.

"The Mangfall was tidal on the day."

The accused repeatedly tried to look for his friend.

"In such cases, we have the task of preventing this if there is a risk of self-harm," the police officer clarified.

The 32-year-old, like his colleague, saw the mood and the accused's attempt to look for his friend as "completely understandable and understandable".

But that doesn't justify an attack on the police officers.

Even if he didn't see the blow, he saw "how he attacked my colleague with both hands," said Holzkirchner.

"Suddenly the colleague swayed and fell into my arms."

Fine despite understanding of the exceptional situation

The prosecutor spoke of an "exceptional situation", but saw the allegations as confirmed.

She demanded a year's imprisonment on probation and the payment of 600 euros to a non-profit organization.

"I'm really sorry about what happened to the police officer," said the accused, who appeared without a lawyer.

"But I believe that it happened through the wall of a building and not through a blow from me." But judge Walter Leitner was convinced that the blow had been committed and sentenced the Miesbacher to 170 daily rates of 40 euros each.

"You were heavily intoxicated with 1.88 per mille," said Leitner to the accused.

"The starting point was that as a host you felt responsible for your friend and wanted to help him." It was right for the police to prevent him from looking for his friend.

"But you can understand how you were there." Despite the tragedy, the 41-year-old could not avoid the fine and compensation of 1,500 euros to the adhesion plaintiff.
