Olympic aquatic center of Aubervilliers: justice again orders the stoppage of work

for the construction site of the Olympic aquatic center of Fort d'Aubervilliers (Seine-Saint-Denis).

The Paris Administrative Court of Appeal whistled this Wednesday a new stoppage of work, already interrupted from September 20 to November 23, 2021 by the courts for illegalities noted on the building permit.

The court ruled in favor of the environmental associations (Environnement 93 and MNLE 93) as well as the three gardeners who had filed an interim order to request their interruption.

The activists, opposed to the demolition of 17 allotment plots as part of this project, were already basing themselves on a court decision dated February 10, which had invalidated the zoning of the last PLUI (local inter-municipal urban plan) voted by the Plaine Commune territory.

It is in particular the outdoor area of ​​the swimming pool, where the gardens are located, which was pointed out by the court, which considered that it included “a UM

(mixed urban) area,

the precise nature of which is not justified.

The work had continued despite the rejection of the PLU

The territory had four months, that is until June 10, to review its copy concerning this famous part of the aquatic center, which must accommodate fun activities and a solarium.

Equipment deemed essential to the future economic balance of this project at 33 million euros (including ten financed by Solideo, the delivery company for the Olympic works), but whose surface could therefore be reduced.

The territory and the city of Aubervilliers, project owner, had however considered that the site could continue.

Particularly in view of the urgency of completing the equipment which must be returned before January 2024 to be able to be used, during the Olympic Games, as a training center for athletes.

To which environmental activists opposed another urgency: that of preserving plots already razed by diggers, but where concreting would be imminent according to gardeners.

“The justice considered that the municipality could not continue the work as if nothing had happened, recalls their lawyer Pierre Heddi.

This is very good news because it was the fastest way to draw all the consequences of the February 10 decision.

Interrupting the work as quickly as possible was our priority.

This Wednesday at the beginning of the afternoon, the activists expressed their joy at the announcement of the court decision.

"It's extraordinary news, an indescribable joy," enthuses Dolorès Mijatovic, activist for the collective for the defense of allotment gardens.

“The work on the pool must be suspended immediately!

“Also recalled the Jardins à Défenseur (JAD) collective, insisting on this urgency on all these social networks.

In recent weeks, several actions had been carried out, in the early morning, to prevent trucks from accessing the site.

The other actors in the case have not yet reacted.
