Court overturns mask requirement in clubs

The obligation to wear masks in clubs, discos and shisha bars in Lower Saxony has been temporarily suspended by the Higher Administrative Court (OVG).
This was announced by the court in Lüneburg on Friday.
The operator of a nightclub in Osnabrück opposed this regulation.
The court decided that the regulations were not a necessary protective measure within the meaning of the Infection Protection Act and were also not appropriate.
Hanover/Lüneburg - The decision is final.
Clubs and discotheques in the state have been allowed to reopen since last Friday.
So far, the mask could only be removed when seated, it had to be worn when dancing.
The access rule is not discussed in the resolution - so the 2G plus rule continues to apply indoors and outdoors of these companies.
Those who have not been vaccinated against the corona virus or have recovered from an infection will not have access.
Anyone who has not yet had a third vaccination also needs a negative test.
According to the state government, young people under the age of 18 are not exempt from these requirements, in contrast to other areas of clubs and discos.

The Ministry of Health announced that the state government of Lower Saxony took note of this decision and that the result was that the corresponding regulation in the Corona Ordinance would no longer be applied with immediate effect.
Several corona rules of the state government were overturned by the OVG, such as the 2G rule in retail in Lower Saxony shortly before Christmas or the upper limit for open-air events in February.
