A former magistrate was sentenced to two years in prison, including one year suspended, for having offered Internet users sexual relations with his 13-year-old daughter, without taking action, Friday March 11 in Besançon.

This 56-year-old father of three, who was vice-president of the Dijon court, was also subject to an obligation of care and a ban on exercising a voluntary or professional activity in connection with minors.

The former magistrate, who did not appear at the hearing on February 18 because of "

his state of health

", will be able to serve the firm part of his sentence under electronic surveillance at his home, where he still lives with his family.

The man, whose name is withheld by AFP to preserve the identity of his minor daughter, will be listed as a sex offender.

He had already been revoked last July by the Superior Council of the Judiciary (CSM), but this decision is the subject of an appeal before the Council of State.

Trauma

The case started in October 2019 when the user of a libertine site reported that a man proposed that his daughter, then 12 years old, be associated with sexual intercourse with his wife.

Without a criminal record or addiction problem, the former magistrate admitted to having written these messages, but affirmed that they were “

fantasies that he would never have materialized

”.

Also a magistrate, his wife had been exonerated from the end of her police custody.

During the hearing in mid-February, the defense insisted on a "

trauma

" linked to the Pierre Bodein case, the multi-recidivist nicknamed "

" and sentenced to life imprisonment for three savage murders and two rapes committed in 2004 The defendant, who claimed to have had suicidal thoughts and anxiety attacks afterwards, was general counsel during the assize trial of Pierre Bodein in 2007, shortly after the birth of his daughter.
