A fake police officer is said to have abused his girlfriend.

He was acquitted in the first instance, but the public prosecutor's office did not give up.

– The public prosecutor’s statement of grounds for appeal speaks of a “repeated pattern of behavior on the part of the accused towards women”.

In fact, the 35-year-old defendant from the Freising district, who has to answer to the regional court for sexual assault, dangerous bodily harm and deprivation of liberty, was sentenced to two years and eight months in prison for an almost identical incident in October 2020 - only that it was another woman.

Just a month after the trial, the 35-year-old wrote to a police officer on a dating platform.

He is also said to have held her overnight in her apartment in Freising six months later, forced her to perform sexual acts and physically attacked her.

But the foster mother of the 35-year-old gave him an alibi in front of the district court last summer: he was acquitted.

After the public prosecutor's office lodged an appeal, the second criminal division of the regional court now has to deal with the case.

The accused again denied the allegations.

However, his demeanor was visibly more modest than in the previous negotiations.

The 27-year-old thought she had won the lottery with the accused – until she found out from colleagues that the scammer, who had been marching through Freising as a fake police officer for some time, was her boyfriend.

The 35-year-old simply "borrowed" parts of his girlfriend's uniform.

The relationship ended;

both the accused and the policewoman stated in court that the end had come from them.

On June 21, the 35-year-old brought a few things to the policewoman that he still had from her.

Then the descriptions diverge: The accused claims to have refused his ex's invitation to come into the apartment and to have gone to his foster mother.

The policewoman confirmed the charges in court, according to which he locked her in the apartment, humiliated her and attacked her.

According to the public prosecutor, the foster mother was not credible as a witness because she was emotionally connected to the accused.

She also gave different statements to the police and to the court.

The police had noted, for example, that the accused, according to the 69-year-old, did not come to her until 1 p.m. the day after the night of the crime.

Foster mother exonerates accused

"But that doesn't rule out the fact that he stayed with me the night before," said the witness on Monday.

Although she was the first to go to bed the day before, his shoes were still standing around the hall the next morning.

She then went for a walk with the dogs and when she came back he was already gone.

You have no evidence that he left the apartment at night.

"Otherwise the dogs would have barked." Regarding her foster son's relationships in general, the 69-year-old said, "they were more or less all not easy".

The trial will continue on Thursday.
