The federal government wants to regulate the taxation of pensions.

A recent study shows who can draw the greatest tax benefits from the plans of the traffic light coalition.

Berlin – The new regulation of pension taxation* planned by the traffic light can lead to a total relief of up to around 23,500 euros for individual taxpayers in the future.

Pension taxation: complaint from the BFH

As a reaction to a ruling by the Federal Fiscal Court (BFH) in May last year, the federal government wants to make the amounts to the pension fund and, above all, later pension payments significantly better for tax purposes.

In its ruling, the BFH had complained that the transitional regulation on the subsequent taxation of pensions, which has been in force since 2005 and will last until 2040, will lead to unconstitutional double taxation in the future.

Germany's highest financial judges had therefore demanded a new regulation from politicians.

So far, according to the transitional regulation, pensions from the statutory pension insurance scheme have been gradually* taxed more and more, while contributions paid for old-age provision can gradually be deducted from tax in larger amounts.

In 2040, the proportion of the pension that is taxable should then be 100 percent.

Accordingly, a pensioner who retires in 2006, for example, receives 52 percent of his or her salary.

In contrast, for a new pensioner who leaves the world of work behind in 2022, 82 percent are already taxable.

Pension: Traffic light plans step-by-step plan

The traffic light is now planning to extend the phased plan to relieve the burden.

For example, pension expenses should not wait until 2025, but be recognized 100 percent from 2023.

Full taxation of pensions will be stretched from 2040 to 2060 and thereby relaxed.

The taxable portion will increase more slowly from 2023 - gradually by 0.5 percent per year and not by a full percentage point as before.

Accordingly, it is recorded in the traffic light coalition agreement.

The legislation on this is currently being prepared in the Federal Ministry of Finance by department head Christian Linder (FDP).

Pension: Large tax advantages for those born in 1975 and 1980

According to Siepe's example calculations, the people born in 1975 have the greatest advantage from the new regulation: For average earners who currently earn around 3,250 euros gross per month, the planned changes will lead to a tax advantage of almost 12,500 euros, the newspaper reported.

In the case of top earners, who are always above the contribution assessment limit for pension contributions (currently EUR 7,050 per month in West Germany), the tax benefit is almost twice as high at around EUR 23,500.

Those born in 1980 came second best, with a tax advantage of around 9,950 euros (average earners) or 18,800 euros (top earners).

In contrast, there are tax benefits of less than 9,000 euros for those born in 1960. Those born in 1990 do even less well.

Siepe also criticizes the coalition's plans, according to a German pension insurance portal, meine-pension.de.

He is particularly bothered by the fact that pensioners who retire before 2023 * would not benefit from the new regulation.

If they assume double taxation for their pension, "they would have to prove this and go the long way via objection to the income tax assessment at the tax office, complaint at the responsible tax court and possibly up to an appeal at the Federal Fiscal Court".
