Donald Trump may have committed a criminal offense after his election defeat by Joe Biden.

Washington, DC - The 2020 presidential election is still preoccupying the United States to this day.

Of course, the focus is on none other than Donald Trump, who never accepted defeat by Joe Biden.

Trump would have preferred not to leave the White House in the first place.

In fact, he may have intended to stay in power illegally.

At least one federal judge is now seeing evidence Trump may have committed a criminal offense in January 2021.

"Based on the evidence, the court finds it highly probable that President Trump corruptly attempted to obstruct the January 6, 2021 joint session of Congress," said David Carter in a decision in Santa Ana, California.

This could constitute a criminal offense of obstruction or attempted obstruction of an official procedure.

Carter ordered Trump's adviser, John Eastman, to hand over 101 emails to the investigative committee into Trump fans' storming of the Capitol.

Donald Trump: Judgment is turning point

The verdict marks a turning point and paves the way for the House Special Committee to receive some of the most serious emails from Eastman about his illegal plot to overturn the 2020 US election, which he has been doing everything he can to keep secret despite a subpoena Has.

The legal basis for the Eastman plan rests on an 1887 law that Eastman believes allows the vice president to overrule disputed election results.

So Mike Pence should have refused to count Electoral College votes for Biden.

Pence, who chaired the session, declined.

After an inciting speech by Trump, his fans stormed Congress.

The attack killed five people and injured dozens.

Trump maintains to this day that he was only robbed of the election victory by massive fraud by the Democrats.

However, his camp failed with dozens of lawsuits against the election results.

"Trump and Eastman justified the plan with allegations of voter fraud - but President Trump probably knew that justification was unfounded and therefore the entire plan was unlawful," Carter's decision said.

"The illegality of the plan was obvious." Every American knows that in a democracy politicians are elected and not simply appointed.

"President Trump knowingly attempted to undermine this fundamental principle." Had the plan worked, "it would have permanently ended the peaceful transfer of power."

Donald Trump is yet to face criminal charges

Neither Trump nor Eastman have yet to face criminal charges for the storming of the Capitol.

Carter made it clear that his case was only about a dispute over the release of emails.

"It is not a question of criminal prosecution." However, the federal judge demanded that the events be clarified on January 6, 2021 and that those responsible be held accountable.

Otherwise, the court fears “that January 6th will repeat itself”.

Neither the judge nor the House committee has the legal capacity to prosecute Trump or his allies for the alleged conspiracy.

That decision falls to the Justice Department, which is under pressure, particularly from the left, to be more aggressive in targeting those they believe were ultimately responsible for the storming of the Capitol.

This means Trump and his inner circle.

Donald Trump: criticism of the judge

Trump himself initially does not comment on the judge's verdict.

His spokesman Taylor Budowich spoke up for this.
