The majority union among magistrates has filed a new complaint against Éric Dupond-Moretti, accusing him of having taken advantage of his duties as Minister of Justice to demand accountability for the management of a magistrate while a "

serious incident

" opposed them when he was a lawyer.

In its complaint to the Court of Justice of the Republic (CJR), consulted by AFP, the Union of Judges (USM) considers that these facts are part of an "

illegal taking of interests

".

According to the USM, the director of the minister's cabinet asked the General Inspectorate of Justice (IGJ) on July 1 for a "

situation review

" of the Cayenne Court of Appeal, a court chaired by Marie-Laure Piazza, “

in order to understand in particular the repercussions

” of its organization “

on the health of magistrates and civil servants

”.

After a report, delivered in December, the Prime Minister's Office requested on January 24 the opening of

“, adds the union.

"Deleterious relationship"

Contacted by AFP, Matignon confirmed this request to open an investigation.

However in 2016, while this magistrate was presiding over the Assize Court of Haute-Corse, “

Éric Dupond-Moretti, lawyer for one of the accused, had publicly reproached him for putting pressure on the jurors

”, notes the USM.

The lawyer had received a legal warning for these facts, judicial sources told AFP.

For the USM, "

the deleterious relationship

" between

Éric

Dupond-Moretti and Marie-Laure Piazza "

was likely to prevent, due to a conflict of interest, any act

" as minister "

concerning the management of the Cayenne Court of Appeal

.

The CJR told AFP that this complaint had not yet reached it.

It is again a pure communication operation

”, for its part reacted the entourage of the minister.

The USM had already filed a complaint against Éric Dupond-Moretti in December 2020, jointly with the Syndicat de la magistrature (SM, left).

The two unions already accused him of having taken advantage of his functions as Minister of Justice to intervene in cases for which he was previously a lawyer.

These complaints led to the opening of an investigation by the CJR and then to the indictment of the minister for illegal taking of interests on July 16.
