An abandoned car in the field: Apparently the driver had made off with the license plates after an accident - but forgot one detail.

Egling/Bad Tölz – When the police arrived at the accident site in Egling at around 1.30 a.m. on January 1 of last year, they found only a slightly damaged car.

The Audi had apparently shot straight ahead over the traffic island at the roundabout, had rolled down a sign and touched a tree before coming to a stop in an adjacent field.

The headlights shone, both license plates were removed.

There was no trace of the driver.

However, the vehicle owner was quickly found based on the environmental badge on the windshield.

The police met him two hours later in his apartment in Bad Tölz.

With almost 0.9 per thousand alcohol in the blood.

Now the 40-year-old trained car mechanic had to answer to the district court for negligent drunkenness and unauthorized removal from the scene of the accident.

The man was fined €4,500 and his driver's license revoked for a total of 15 months.

The accused remained silent during the hearing about the events of that New Year's Eve.

"Nobody saw that he drove straight ahead over the traffic island in his red Audi," judge Helmut Berger later stated in his verdict, "but so much evidence was gathered that the court was certain that he was driving."

The accused was in possession of the car keys, and the license plates were also in his apartment.

How the car, which he thought was parked in the yard, got to Egling, he does not know, reported a policewoman from her conversation with the accused.

Traces of the Tölzer's DNA were found on both the driver's and the passenger's airbag.

The driver's door could not be opened by the police at the scene of the accident.

"There's a good chance he was behind the wheel"

The court considered the fact that his fiancée had been driven home by her mother the next day as further evidence that the accused had made his way home in his car that night.

It was unclear how the man got home from the scene of the accident.

"His mistake was that he didn't clean up the DNA evidence," said the judge, who had "no doubts" about the accused's guilt.

He sentenced Tölzer, who had many previous convictions, to 90 daily rates of 50 euros each (a total of 4500 euros) and thus remained under the request of the public prosecutor, who had demanded 6000 euros (120 daily rates).

The defense had requested an acquittal "according to the principle of "if in doubt for the accused".
