In the early days of the fifth wave, Kwai Chung Village was sealed off for seven days, and a large number of residents could not go to work as usual.

Even residents who live nearby have been denied work by employers, citing close contacts as close contacts.

However, a large number of residents were forced to take annual or unpaid leave because they were unable to provide relevant documents for quarantine or isolation.

Although the Government has gazetted the Employment (Amendment) Bill 2022, the Bill has not yet been formally passed.

The Federation of Trade Unions said today (6th) that it has received requests from 327 members of the public since February. One of the outsourced cleaners had been infected with the virus and was issued a quarantine order. For this reason, she was required to use annual leave or unpaid leave to compensate for the 14-day home quarantine.

The Federation of Trade Unions urges the government to pass the ordinance as soon as possible to protect the interests of employees.

Legislative Council member Leung Tsz-ying said that the Federation of Trade Unions (FTU) has set up an online declaration platform earlier to help resolve labor disputes arising from quarantine or quarantine certificates. Since February, 327 citizens have received requests for help.

He pointed out that the cases for help can be divided into four categories, including those infected with the virus and those who were in close contact, who needed to be isolated or quarantined during February, but the government did not have a relevant reporting platform at that time, so they could not obtain supporting documents.

The other category is patients who have successfully obtained the supporting documents and those who have been closely diagnosed, but need to be revised due to the difference between the date of community testing and the date of test results.

The remaining cases include citizens who were diagnosed after rapid testing, but did not report immediately, and were not able to obtain quarantine orders; there were also disputes over whether or not to count close contacts as sick leave during the quarantine period.

In one of the outsourced cleaner cases, the victim contracted the virus in late March and followed the government's instructions to isolate at home and was issued a quarantine order.

However, the company later asked her to deduct her annual leave or take unpaid leave to compensate for the 14-day home quarantine on the grounds that the government did not legislate that the quarantine order could be regarded as sick leave.

She said that "I don't know how to calculate it", but the employer insisted that "the government will not be held accountable without legislation" and shirk its responsibility.

Liang Ziying criticized the management's actions as extremely unreasonable, and is continuing to assist the victim to follow up.

The FTU will refer the case to the Centre for Health Protection for follow-up

Leung continued to point out that after receiving a request for assistance from the public, the Federation of Trade Unions will obtain relevant information from the victim and forward it to the Centre for Health Protection.

Most of the cases have been accepted by the Centre for Health Protection, and the isolation order or quarantine order has been reissued.

Wong Kwok, chairman of the Federation of Trade Unions and a member of the Legislative Council, said that he urged the Food and Health Bureau to speed up the approval process for quarantine and isolation documents, and to set up a dedicated line to solve the problems and inquiries of the affected citizens.

He also appealed to employers to be considerate of their employees' situations and to handle cases flexibly.

He went on to point out that since the number of infected people in Hong Kong exceeds one million, even if only 1% of the controversial cases involve 10,000 people, the problem needs to be taken seriously.
