If you are unable to work because of illness or a disability, you may be entitled to a disability pension.

An overview of the regulations.

According to the social association VdK, there are around 1.8 million disability pensioners in Germany.

All insured persons are entitled to a disability pension - with some restrictions.

Who is entitled to a disability pension?

On the one hand, employees would have to fulfill a minimum insurance period of five years in the pension insurance, says Dirk von der Heide from the German Pension Insurance Association.

In addition, they must have paid compulsory contributions for dependent employment or self-employment for at least three years in the past five years before the onset of the reduction in earning capacity.

In addition, certain health criteria must be met: Those who are no longer able to work at least six hours a day meet these criteria.

"The pension insurance checks this on the basis of medical documents," says von der Heide.

The insurance uses this to determine whether the applicant's ability to work can be fully or partially restored through medical or occupational rehabilitation measures.

"This principle is called "rehab before retirement"," says VdK President Verena Bentele.

Disability pension: Can rehabilitation measures restore the ability to work?

If it is not possible to restore the ability to work through a rehabilitation measure, an examination is carried out to determine the extent to which an applicant can still work.

It depends on whether those affected are eligible for a pension due to a full or partial reduction in earning capacity.

Those who, for health reasons, can work less than six hours a day receive a partial disability pension.

"It should supplement the income from a part-time job that is still possible," says von der Heide.

If the ability to work has fallen to less than three hours a day, there is a pension due to a full reduction in earning capacity.

"It is twice as high as the pension due to partial disability," says the expert.

The amount of the pension is calculated from the personal earnings points

How high the EM pension is in the individual case is calculated from the insurance periods completed so far.

The basis is, among other things, the personal earnings points achieved by the insured person.

In addition, people with reduced earning capacity are treated as if they had continued to work and paid contributions with their previous average income.

"As a result, they receive a higher pension," says von der Heide.

In principle, recipients of an EM pension may also earn additional income.

However, certain income limits must be observed.

If it is exceeded, the pension will be reduced.

A fixed additional earnings limit applies to a pension due to a full reduction in earning capacity.

It is 6300 euros per year.

The additional earnings limit for a pension due to a partial reduction in earning capacity is calculated individually.

For 2022 it is at least 15,989 euros.

The time required for the activity also plays a role.

Whoever works three or more hours a day as a recipient of a pension because of a full disability or six or more hours a day as a recipient of a pension because of a partial disability may lose his pension entitlement.

Therefore, recipients of an EM pension should find out about the effects on their pension before starting work, advises von der Heide.
