During the period, the FEHD launched prosecution procedures against the persons in charge of 10 catering premises suspected of violating the instructions. Three of the prosecutions involved "wearing masks" and "ensure customers scan the QR code of safe travel places", and "ensure employees are vaccinated" ", "Distance or separation between tables", "Display of notices not to eat and drink in areas adjacent to catering premises during no dine-in hours" and "Ensuring that customers meet the requirements of vaccine passports", each with one related prosecution.
The spokesman pointed out that the illegal premises must suspend the sale or supply of food or drinks for eating or drinking in the catering business premises from 6:00 p.m. to 4:59 a.m. on the next day after law enforcement officers discovered the violation. No more than 2 people may be seated at the same table for 3, 7 or 14 days.
A person in charge of a catering business who violates the requirements and directions of the Regulation or the Vaccine Pass is liable to prosecution and, upon conviction, to a fine of up to $50,000 and imprisonment for six months.
Persons present at catering premises or other specified premises are also required to comply with the relevant requirements applicable to them. A breach of the relevant requirements is an offence punishable by a maximum fine of $10,000.
The person concerned may be discharged from liability for the offence by paying a fixed penalty of $5,000.
In addition, customers who violate the maximum number of people sitting at a table in catering premises can be subject to a fixed fine of $5,000 in accordance with the Prevention and Control of Disease (Prohibition of Gathering) Regulation (Cap. 599G); Failure to wear a mask when not eating or drinking will result in a fixed fine of $5,000 for contravening the Prevention and Control of Disease (Wearing of Masks) Regulation (Cap. 599I).
