A person in charge of a catering business who violates the requirements and directions of the Regulation or the Vaccine Pass is liable to prosecution and, upon conviction, to a fine of up to $50,000 and imprisonment for six months.

Persons present at catering premises or other specified premises are also required to comply with the relevant requirements applicable to them. A breach of the relevant requirements is an offence punishable by a maximum fine of $10,000.

The person concerned may be discharged from liability for the offence by paying a fixed penalty of $5,000.

In addition, customers who violate the maximum number of people sitting at a table in catering premises can be subject to a fixed fine of $5,000 in accordance with the Prevention and Control of Disease (Prohibition of Gathering) Regulation (Cap. 599G); Failure to wear a mask when not eating or drinking will result in a fixed fine of $5,000 for contravening the Prevention and Control of Disease (Wearing of Masks) Regulation (Cap. 599I).
