The Commission of Audit released its latest audit report today (27th), which includes a review of the work of the Labour Department.
The report found that from 2016 to 2021, the Labour Department had 3,162 referral cases of suspected non-payment or overdue payment of wages by construction sites, of which 1,235 involved contractors delaying payment for two consecutive wage periods or more, of which 514 Zong's site has not been inspected by the Labour Department.
The report also pointed out that only about 104,000 workplace inspections were made in 2020, 26% less than the target number; the Audit Commission maintained a workplace database with the Labour Inspection Division based on the information of 78 companies that had successfully applied for the "2020 Employment Support" plan. Regarding inspections of construction sites, the report stated that from January 2016 to May 2021, the Labour Department received 3,162 referral cases for suspected non-payment or overdue payment of wages, of which 1,235 involved contractors delaying payment for two consecutive years or above, but there were 514 cases where the construction sites had not been inspected by the Labour Department, accounting for 44%; there were 516 “obvious irregularities” involving contractors continuing to pay wages overdue at different construction sites, and 112 of them were Not inspected by the Labour Department.
The report also revealed that the Labour Department conducted 1,045 inspections of construction sites during the same period, of which 201, or 19%, had completed the construction work at the time of inspection, and there were no construction workers on site.
The number of inspections against illegal workers is lower than the annual target of 26%
Labour inspectors under the Labour Department are responsible for inspecting workplaces to ensure that employers abide by labour laws and combat the employment of illegal workers. According to the audit report, the Labour Department conducted only 104,138 inspections in 2020, which is less than the annual performance target of 140,00026 %.

Audit considers that the Labour Department needs to consider formulating a contingency plan for the management of inspections, and suggests that it is necessary to study innovative measures in conducting workplace inspections to meet the requirements of reducing social contact, and to enhance the comprehensiveness of the workplace database to facilitate Plan inspections.
With regard to sites, Audit recommends that construction sites that meet the selection criteria of the Labour Inspection Division's Code of Conduct are fully considered and given priority in the selection of workplaces for inspection; and measures are taken to ensure that construction sites are available before the completion of construction works Inspection, including studying effective measures to speed up the referral of cases to the Labour Department; the Labour Department agrees with the audit recommendations.
