The Court of Justice of the European Union (CJEU) called several countries to order on Tuesday, including France, which have reintroduced these exceptional measures since 2015 and have renewed them since: controls must not exceed a period of six months, the court ruled.

And if the measure is renewed, this must be correlated to "

a new serious threat affecting (the) public order or (the) internal security, which is distinct from that initially identified

".

“Violations of the fundamental rights of exiled people”

A re-establishment of border controls in the Schengen area "

can only be exceptional and cannot in any case be established over time to the point of becoming the norm

The signatories call on France to “

put an end to the extension of internal border controls

”, reintroduced from May 1 for six months, and “ thus put an end to the

daily violations of the fundamental rights of exiled people who present themselves there (violence , racial profiling, failure to respect the right to asylum and the rights of the child, confinement)

”.

France has reinstated these controls since the November 2015 attacks, citing the terrorist threat.

Since 2017, the scheme has been systematically extended every six months.

It is not the only country targeted by the CJEU's decision: Austria, Germany, Norway and Sweden took the same decision in 2015 -and Denmark since 2016-, with random checks invoking the migration crisis and/or the terrorist threat.

Schengen is in principle an area of ​​free movement between 26 countries (22 EU countries plus Iceland, Liechtenstein, Norway and Switzerland), where these checks are authorized by the Schengen code on an exceptional and provisional basis.
