A Haushamer ordered goods at the expense of a hotel in Tegernsee where he was employed and had them delivered to his home.

It wasn't the first time.

Tegernsee/Hausham – According to the indictment, the acts took place between April 2020 and January 2021, when the 55-year-old was employed in a managerial position in a Tegernsee hotel.

His duties involved him directly with the hotel's funds - which he apparently shamelessly exploited.

He ordered goods through the company and had them delivered to his home address - including a couch, coffee table, printer, webcams, microphones and sauna concentrates.

He is said to have sent himself a total of 2,660 euros in company money three times via Paypal.

As if that were not enough, he independently transferred another 710 euros from the hotel account to his private one – this time for moving costs.

The 55-year-old also reached into the hotel's cash register.

There were a total of 40 cases of infidelity with a majority of the crimes in the room.

"I can't explain myself why it happened again," said the defendant, who mostly confessed, at the session of the lay judges' court in Miesbach.

Again, because the man had been in prison for several years for infidelity in more than 100 cases - at that time worth millions and with identical procedures.

He was "infinitely sorry" for his relapse, said the 55-year-old with a trembling voice and tears in his eyes.

"I wanted to offer something to my family."

Moving costs would have been reimbursed - but not without prior agreement

In the early days, she lived in the Tegernsee Hotel a few hundred kilometers away.

The air travel on the weekends would have cost him quite a bit, as would the double rent.

He processed old hotel bills on the computer and changed the delivery address.

It was customary for him to release invoices on behalf of the managing director.

Today he pays back the damage caused by him in installments.

"I also returned the things to the hotel," he emphasized.

The whole thing was blown up by a hotel employee who noticed some discrepancies.

"Things were bought that the hotel didn't need at all," said the 53-year-old on the witness stand.

But she only became really suspicious when it came to PayPal payments and cash withdrawals from the cash register.

The manager of the hotel was speechless in court when he learned that the accused had the right to release invoices on his behalf.

The 54-year-old also explained that moving costs would be reimbursed up to 5,000 euros, but said in the same breath: "He can't just transfer something himself without discussing it."

One year and ten months in prison - without parole

When Haushamer's acts of infidelity were noticed, the managing director turned on the audit.

"They assured him that if he cooperated, he would be given a timely dismissal and no criminal charges would be filed," he reported.

The 55-year-old should have provided a complete list of all orders and transactions.

"We found more cases without his doing," added the 54-year-old.

Around 12,000 euros would be in total as damage in the room.

In the end, 38 cases of commercial infidelity remained for the public prosecutor.

Mainly because of the criminal record and the large number of acts, she demanded a prison sentence of two years and nine months.

Defense attorney Max-Josef Hösl referred to the new job that his client now has: "There they value him as very loyal and competent".

He pleaded for a two-year suspended sentence, which would allow the 55-year-old to remain in the profession.

But after almost five hours of negotiations, it was clear: Haushamer must be in prison again for a year and ten months.

"You have done again 38 times what you have been in prison for more than five years," Judge Walter Leitner justified his verdict.
