The year before last, 12 Hong Kong residents fled to the mainland by boat and were intercepted. One of them, Huang Weiran, was returned to the mainland after serving his sentence in the mainland. Today (12th), he pleaded guilty to the crime of making explosives in the District Court.

The case revealed that the police found a large amount of materials used to make explosives DNT at his residence. He also admitted that he had made a piece of explosive and left it in the mud in the backyard of his residence.

However, during his bail, he decided to abscond after being introduced, and was arranged to learn to drive a boat, but was eventually arrested.

Huang did not admit to the crime of obstructing justice. He only pleaded that he made explosives because of playfulness, and said that he acted personally and did not involve other people.

When sentencing, the judge pointed out that the incident coincided with a social movement, and the serious consequences of dangerous goods falling into the hands of others could not be ignored, and sentenced Huang to 20 months in prison.

Defendant Huang Weiran pleaded guilty to one count of making explosives, accusing him of making explosives, commonly known as DNT, near Wu Uk Village on Sha Tau Kok Highway from December 1, 2019 to January 14, 2020.

There are multiple materials in the home that can be synthesized into explosives

The facts of the case refer to the fact that the police arrested Huang at his residence on January 14, 2020, and found multiple items containing dinitromethane tea (DNT), sulfur, high-concentration nitric acid, high-concentration sulfuric acid, etc. utensils, which the government chemist confirmed to be the material used in the synthetic explosive DNT.

Recognized to have refined high-performance explosives

The police then searched the backyard of Huang's residence and found a mixture of soft lumps in a thin plastic bag and shards of glass from a rotten container in a loose, cloudy and moist soil. The defendant, under caution, said the soft lump was Explosives, "refined" by himself at home.

The defendant later stated in the video interview that the soft blocks were poisonous high-performance explosives DNT or mononitrotoluene (MNT). However, after finishing the production, I thought it shouldn't be done and I didn't know what to do with it, so I decided to bury it in the ground.

Arranged to learn to abscond

The defendant was later released on bail in February 2020. In July, he met "Grace" through a friend's introduction. The other party said that he would help Huang to smuggle Taiwan by boat and finance the cost of absconding.

By the beginning of August, "Grace" arranged for a coach to take Huang and other three people to Tai Po to learn how to sail a boat for use in the absconding plan.

As of the early morning of August 23, Huang and 12 others left Hong Kong by speedboat, but were intercepted and arrested by Chinese law enforcement agencies when they illegally entered inland waters later.

Pleading that it's just for fun

When the defense pleaded for mercy, it pointed out that the defendant committed the crime only for fun, and then buried the explosives involved in the wet soil. It was neither brought to other places for use nor intended to hurt people, and the potential risk was low.

The defense also pointed out that the defendant acted as an individual from beginning to end.

Officials say seriousness of explosives cannot be ignored

The judge sentenced that the making of explosives is a serious crime, and the incident coincided with a social movement. The court cannot ignore the serious consequences that could result if the explosives fell into the hands of others.

However, the court took into account the low severity of this case among similar cases, and that the defendant buried explosives in the soil, and there was no electrical pipe that could be used for detonation, and sentenced him to 20 prison terms.

Obstruction of justice allowed to file without prosecution

Huang Yuan was also charged with one count of conspiracy to commit an act of inclination and obstruction of justice, alleging that from December 2019 to August 23, 2020, together with the names "Wazhong", "Grace" (alias: Aunt, Aunt, Aunt or Sister) and "Zizi" and others, with intent to obstruct justice, by committing one or a series of acts with a tendency to obstruct justice, causing 12 Hong Kong people to flee the Hong Kong jurisdiction in order to obstruct police investigations, or Criminal proceedings arising out of the investigation.

The crime was filed in court without prosecution.
