A 34-year-old from Dießen has had to answer to the Munich district court since Wednesday.

He is said to have hit an 87-year-old woman on her terrace in Wessobrunn while intoxicated with drugs with intent to kill.

– Although the public prosecutor's office assumes that the man is innocent, they have filed charges: However, not for attempted manslaughter, but for intoxication.

She is very nervous, says the sprightly 87-year-old as she sits in the witness chair.

It was a beautiful Sunday, May 10th of the year before last.

The former teacher recalled that she spent the afternoon on the terrace of her house on the outskirts of Wessobrunn.

When she was about to jump into the house at around 7 p.m., the accused entered her property through the garden gate.

"There is no passage here," she rebuked him.

However, the 34-year-old "stubbornly continued like a robot".

Suddenly the accused grabbed her by her jacket, "pulled her down from the terrace" and "continuously boxed and kicked her with both fists".

In order to defend herself, she "boxed back" and tripped the accused.

She was able to use the time it took the man to get back on his feet – despite her walking disability at the time – to drag herself to the front door.

Stranger out of control - rescue at the very last second

The accused kept shouting: "You old witch.

I'll take you there now".

When she looked him in the eye lying in the entrance to the house, she realized: "He's going to kill me".

After kicking the accused, however, she was then able to "slam the front door and turn the key".

But that's not all: The accused kicked the front door from the outside and smashed the door glass with his crutches.

In her fear, she fled to a hidden room in her house.

However, she was unable to contact the police from there: "No reception," the old lady complained.

It took about half an hour for her to be freed, the 87-year-old said.

Already on the terrace she called for help.

According to the indictment, this was heard by neighbors.

A few minutes later, the 34-year-old was arrested by the police.

He is said to have resisted his arrest violently, slightly injuring a police officer and spitting on another.

The pain goes away, the fear remains

The old lady was lucky in her misfortune: According to the indictment, she suffered a craniocerebral trauma and a broken nose - but without long-term consequences.

Only her eye still causes problems, the 87-year-old complained.

Apparently, the expert could find no evidence of this.

She also has trouble sleeping, "can no longer walk to the garden gate alone" and now always keeps a poker handy to defend herself against uninvited intruders.

The defendant says nothing, but lets his lawyer do the talking

The defendant declined to comment on the allegations on Wednesday.

He had his defense attorney explain that he "takes responsibility".

He says he is "infinitely sorry".

He paid a deposit of 2,000 euros to make amends.

In the run-up to the trial, the 34-year-old had told a psychiatrist that he had smoked cannabis on the day of the crime and the two days before.

It is astonishing that the cannabis apparently caused hallucinations despite the relatively small amount.

Even if the accused was probably incapacitated due to drug use, a conviction is possible.

According to Section 323a of the Criminal Code, anyone who intentionally or negligently gets intoxicated and commits a criminal offense while in a state of incapacity is liable to prosecution.

The negotiation continues.
