During breaks in the hearing on Wednesday, the accused, ex-district administrator Jakob Kreidl (left) and ex-district savings bank board member Georg Bromme (right), here with their lawyers in an archive picture, seemed in a good mood.

However, a medical certificate confirmed that Kreidl had serious health problems that were said to have arisen as a result of the process.

Ex-Sparkassen board member Georg Bromme and ex-district administrator Jakob Kreidl will apologize to the district savings bank for the fact that employees have suffered from Bromme.

Miesbach/Munich – With his testimony in the savings bank trial before the District Court of Munich II, the former Mayor of Weyarn, Michael Pelzer, was unable to shed much light on the district savings bank's previous practice of giving gifts to members of its board of directors.

Gifts were only given at the last meeting before Christmas.

But they never waited for the board of directors, said the 74-year-old.

The auditors of the Savings Banks Association and the government of Upper Bavaria never received any gifts because these were distributed from a sideboard in the foyer by former Savings Banks board member Georg Bromme after the meeting, but the auditors had always left beforehand.

With regard to specific gifts he had received, Pelzer asked for understanding "that my memory is patchy after twelve years".

Pelzer was invited as a witness because from 2008 to 2014 he had witnessed the gift practices as a member of the board of directors of the Kreissparkasse Miesbach-Tegernsee, because of which Bromme and the former district administrator and chairman of the supervisory board Jakob Kreidl are back in the dock in Munich.

As reported, the Federal Court of Justice (BGH) had largely confirmed the first district court judgment from 2019.

From the point of view of the BGH, however, gifts to members of the board of directors violate the principle of thrift and are objectionable.

The district court has been examining these gifts for a good month now.

Pelzer's statement yielded little new knowledge.

When asked by the judge, he did confirm some gifts that supervisory board members had received from the savings bank: a champagne bottle each when visiting a farm – i.e. not at the Christmas meeting – a deer cloth “for the wives”, a bottle holder.

However, he did not report any incriminating news.

He contradicted statements by previous witnesses that there had been gifts at every meeting and also at the seat.

The mood in the dock was correspondingly cheerful.

Bromme and Kreidl, both in suits, joked with their lawyers during a break in the hearing.

The sideboard was in the conference room and not in the foyer, said Bromme to Kreidl with a laugh.

He laughed back and shook his head uncomprehendingly.

After the break, the court turned to the defendants' situation.

Bromme said he was doing "well physically and mentally, according to the situation mentally".

Kreidl presented an expert opinion that attested to cardiac arrhythmia, neurodermatitis, which flared up especially on trial days, and high blood pressure because of the procedure.

He doesn't sleep through the night and needs medication for the rest of his life.

Bromme and Kreidl will apologize to the Sparkasse

As of yesterday, the second savings bank process is about to be completed.

The public prosecutor's office and the defense decided not to hear another witness.

Bromme and Kreidl are scheduled to attend a meeting of the savings bank board of directors today to apologize for their behavior.

The Sparkasse's internal investigation revealed that employees suffered from Bromme and found his personality unpleasant.

If the board of directors accepts the apologies of the defendants, this could have a mitigating effect on the sentence.

The pleadings will follow on Monday and the verdict on Wednesday.
