The release from seizure of the plants is one of the conditions precedent of the investment agreement signed on 10 December 2020 between Arcelor Mittal Holding Srl, Arcelor Mittal Sa and Invitalia.

The plants were seized in 2012 and the right of use was then granted.

According to the extraordinary commissioners of Ilva in As - which still owns the plants - the emissions scenario has changed compared to ten years ago thanks to environmental works and there are grounds for revoking the seizure.

The Prosecutor's Office has a different opinion.

The final decision rests with the Court of Assizes.

The plants were seized on July 26, 2012 on the basis of an order signed by the investigating magistrate Todisco as part of the investigation by criminal association aimed at environmental disaster, food poisoning and the willful omission of precautions in the workplace .

The company was then granted the right of use.

The Court of Assizes of Taranto that received the request is the same one that on 1 June 2021 pronounced the sentence (but the reasons have not yet been filed) of the "Ambiente Svenduto" trial, inflicting 26 sentences (between managers of the factory, managers and politicians) for 270 years in prison and ordering the confiscation of the plants in the hot area.
