Major General Kanjo: Legislative Decree No. 7 is a new opportunity for the released Syrians to return to the fields of work and construction

The Director of the Military Judiciary Department, Major General Muhammad Kanjo, confirmed that Legislative Decree No. 7 of 2022 granting a general amnesty for terrorist crimes committed by Syrians before the date 4-30-2022 came within the framework of a stable and stable legislative policy that adopted the amnesty as a legal means to achieve a number of political, economic and social goals and humanity.

Major General Kanjo made it clear in a statement to SANA reporter that this amnesty complements the general amnesty decrees that preceded it, which included in part terrorist crimes in varying proportions, and it is a comprehensive legal solution for the released Syrians to get a new opportunity to return to the fields of work and construction, pointing out that this amnesty was distinct from what preceded it. One of the decrees that he singled out terrorist crimes only.

Major General Kanjo indicated that this amnesty included all terrorist crimes, whether those stipulated in the Anti-Terrorism Law No. 19 of 2012 or those stipulated in the General Penal Code issued by Legislative Decree No. 148 of 1949.

Major General Kanjo said: The mechanisms for implementing this amnesty and its effects vary according to the stage in which its effect on the crime takes place. Listed before the competent judicial authorities (investigating judges and criminal courts), and the judicial authority in charge of that case decides to drop it, according to the crime being included in a general amnesty after the immediate release of the detainee.

Major General Kanjo made it clear that in the case of crimes for which provisions have been approved that criminalize and punish their perpetrators, the Public Prosecution authorized to implement those rulings automatically declares the expiry of the penalties contained therein, and the convicts are released from those who have begun their implementation, and the summaries of the rulings and other related executive procedures are retrieved with respect to the other convicts. Of those who have not yet begun carrying out their sentences. In both cases, the competent Public Prosecution office shall write off the entry of such judgments from the records of the convicted persons.

Regarding his estimates of the number of those covered by the provisions of this amnesty, Major General Kanjo stated that they are in the thousands, given the decree’s inclusion of those arrested for terrorist crimes and all those who are prosecuted by existing lawsuits before the judiciary, as well as fugitives and those who have absconded from justice with those crimes.

Regarding the limitation of this general amnesty to the Syrians who committed terrorist crimes without foreigners, Major General Kanjo clarified that the foreign terrorist who came to Syria or was sent to Syria for a criminal act in the event that he was covered by the general amnesty means that he must be expelled from the country with a blank legal page as if he had not committed any crime, and that It will also mean re-exporting it to other countries with its dangerous thought and deviant behavior, stressing that Syria rejects such disgraceful behavior from which it suffered so much when its hostile countries exported such people to kill its people and destroy its infrastructure and vital facilities.
