Citizens' initiative Irschenberg rejoices: the municipal council agrees to defer gravel mining

The first big step from the point of view of the citizens' initiative (BI) has been taken: In its meeting on Monday evening, the Irschenberg municipal council unanimously decided to postpone the application by the company Hafner Beton from Bruckmühl from November 30, 2021 for gravel mining in the Oberhasling district.
The approximately 40 listeners in the gymnasium acknowledged the vote with correspondingly emotional loud, long applause.
The aim now is to develop priority areas for mining.
The decision was preceded by an intensive exchange.
As reported, there were, among other things, two talks in which the lawyers from the municipality and BI also took part.
A week ago, the non-public preliminary consultation of the municipal council followed, now on Monday the final decision.

Michael Beiße, the community lawyer, initially summarized the situation.
With the failure of the municipal agreement on January 26, the municipal council had an examination of possible gravel quarrying areas in the municipal area carried out for the designation of concentration areas.
As part of an initial investigation by the Ohin office, possible mining areas were mapped and roughly examined for mining possibilities.
But this is not enough to finally assess distances to residential buildings, nature conservation areas and the integration of mining projects into the landscape and townscape.
Since the project would prevent planning, a postponement is obvious.
As Beiße explained further, the project is to be implemented in the Leitzachtal and thus in a special landscape in the community.
The mining application provides for the mining areas to be located in the immediate vicinity of residential buildings;
In some cases, the distance is only 20 meters from the roadside and around 30 meters from residential buildings.

That's what the council members say
For Florian Kirchberger (FDP/Active Citizens), the postponement is the right way: "Now everything is being put to the test.
We want a positive result for the population.” Franz Nirschl (FW Irschenberg) also supported the approach: “We need more time.
That's why I'm in favor of a postponement.” The independent Klaus Waldschütz, on the other hand, declared that he would vote “after much deliberation”, “but not with the utmost conviction”.
The reason he gave was the cost risk with an uncertain outcome of the process.
Two members were excused from voting: Marinus Waldschütz (FW Reichersdorf) and Markus Nagele (independent), who was the only one who voted in favor of gravel mining in January.
That's what the BI says
At BI, however, the joy of the clear vote was great.
"We are very happy that the result turned out so well," explains BI spokesman Florian Kories when asked by our newspaper.
"We are very grateful to the municipal council and the administration for that." One is aware that the work is only just beginning.
That's why BI offers the community all kinds of support - for example through contacts and know-how.
The district office must now approve the request for deferral.
Assuming this, the municipality has one year to obtain the necessary planning and expert opinions so that it can ultimately identify priority areas for gravel extraction in the land use plan and at the same time lay down framework conditions for extraction.
However, the municipality is not allowed to make any prevention plans.
The boundary between permissible and no longer permissible criteria depends on the location and is therefore not clearly defined - a risky tightrope walk.
