The case of the Bayonne bus driver who, in July 2020, had been beaten to death by two 24-year-old individuals, under the horrified eyes of travelers and onlookers, had shocked France.
However, on May 16, the examining magistrate took the unexpected decision: that of not having the attackers of Philippe Monguillot appear before a jury of assizes but before a criminal court, made up of five professional magistrates
(this new jurisdiction , created by law in 2019, aims to unclog the assizes, a situation which leads to the reclassification of certain crimes as misdemeanors in order to have them tried in corrections. It is currently being tested in 15 departments, including Pyrénées-Atlantiques, Ed).
Which implies requalifying the facts “
in willful violence resulting in death without intention to give
it”, a maximum sentence of twenty years in prison, since the criminal courts cannot go beyond.
