The accusation: You had violated the ban on masking

Schongau – They were all dressed in black, masked with shawls or scarves, had put on black sunglasses and gathered in October 2020 in front of the Schongau school center.

According to the prosecution in the penalty order, identification was either impossible or very difficult.

A couple involved from the district had appealed against the accusation and went to court.

"A face mask, the way you have to wear it, is also a disguise," said the man (63), visibly annoyed.

For him it is a legal dilemma between a mask and the obligation to wear a mouth and nose cover, according to the accused.

He had launched this demonstration at the time.

Above all, they were against the obligation to wear masks for children, he explained.

The group also had provocative signs with them.

“Put those who refuse to wear masks in a camp” or “Anyone who believes the government is stupid” could be read, among other things.

The subject of compulsory masks for children was a central concern of the group, according to the defender of the woman (62).

It was a kind of mourning event to draw attention to the topic.

Due to the insignificance, cases were closed against a payment of money

According to presiding judge Karin Beuting, wearing the mask is a regulation and masking is a ban, pointing out that the accusation of masking remains.

"We can't get around that," she said.

Of course, this is not a huge criminal case, but there are always guidelines, as in this case, says Beuting.

Because of the insignificance, both cases were then dropped for a fee of 300 euros each, payable to the Oberland Bridge.

So was the case, heard another day, of another woman involved in the demonstration, who had also appealed the penalty order.

She also pays 300 euros, then the matter is filed.
