Holzkirchen wants to find companies for the new daycare center

The tender for the extension of the daycare center on Erich-Kästner-Straße in Holzkirchen was recently stopped.

The reason: There were no usable offers.

The introduction of a “substance price escalation clause” is now intended to remedy the situation.

Holzkirchen – There is a lot going on in the construction industry at the moment: The order books are full, but raw material prices are rising and materials are becoming scarce.

The rise in prices in particular makes calculations for public construction projects difficult and prevents companies from tendering for such projects.

The Holzkirchen market is also affected: the expansion of the daycare center on Erich-Kästner-Straße cannot start as planned in spring 2023 (we reported).

In its most recent meeting, the municipal council decided to introduce a “material price escalation clause” that enables companies to include price increases in their range.

The town hall hopes that more companies will take part in the tender.

Due to the problems with the tender, the opening of the extension is expected to be postponed to the end of 2024, as Mayor Christoph Schmid (CSU) announced in the municipal council.

The problem with the tender for the construction work is not only that the material costs are increasing, explained Schmid.

The postponed start of construction for the day-care center is also making economic calculations increasingly difficult for entrepreneurs.

After all, a provider calculates with current prices - and thus runs the risk of no longer being economical in the event of a cost explosion.

Or he demands a risk surcharge and makes unrealistic offers, explained lawyer Tobias Osseforth (Luther law firm, Munich) at the meeting.

With a "material price escalation clause" the companies get security that they will get their higher expenses paid.

The reverse is also true, emphasized Osseforth.

If prices go down, costs could be adjusted to the benefit of the community.

Since not all materials are legally eligible for a material price escalation clause, Matthias Marschner (Planungsbüro Hirner und Riehl) now has to put together the clause for the extension of the daycare center.

This involves a higher effort.

The experts disagree on whether this is paid for separately or is already included in the planning costs, explained Osseforth.

In his opinion, however, no additional costs should be incurred.

In any case, they are not happy about the extra work, said Merschel when asked about the question of costs, but left a specific answer open.

Marschner has now estimated the total costs for the construction project at almost eleven million euros.

In December 2021, the estimate was still a good 9.5 million.

The municipal councils unanimously accepted the administration's proposal to test a material price escalation clause in the day-care center extension.

Josef Meier (Greens) called it a "value retention clause" that was necessary at a time when calculations were difficult.

Josef Sappl senior (CSU) emphasized that it was a "fair deal for both parties".

The re-tendering of the construction work was also decided unanimously.

Mayor Schmid was confident that there would be more offers if the fabric price escalation clause was applied.
