Social hours in the savings bank process: That comes to Bromme and Kreidl

In a few days, the judgment in the savings bank process will become final.
Then Georg Bromme and Jakob Kreidl also have to do their community service.
But when and where actually?

– picking up rubbish in the park, delivering food to the hospital or retirement home: this is what you usually imagine as court-ordered social hours.
They usually serve young people because the court expects it to have an educational effect.
As is well known, the Savings Banks process has shown that social hours can also be used with adults.
As reported, ex-district administrator Jakob Kreidl has to do 200 hours and ex-Sparkassen boss Georg Bromme even 300 hours of community work.
There are rules for the type and period of time, which the court assistance of the Munich I public prosecutor is responsible for enforcing in this case, the head of the press office of the Munich Higher Regional Court, Florian Gliwitzky, informed our newspaper on request.
Court assistance decides on place and time
In principle, the service must be provided by the end of the probationary period.
According to Gliwitzky, court assistance also decides where Mr. Bromme and Mr. Kreidl will work.
It is quite possible to suggest a possible place of work yourself and to state personal interests, inclinations or skills.

However, the judge makes it clear that this is not a request concert.
So the social service should not be perceived as a leisure activity, but as work that is of use to the general public.
The activity should be “meaningful, non-profit and social”, explains Gliwitzky.
Municipalities would usually provide appropriate areas of application.
Certain clubs or other institutions would also offer suitable tasks.
Exemption from community service unlikely
In principle, an exemption from community service is only possible in exceptional cases, for example for health reasons or in exchange for a certain sum of money.
But all of this must be applied for and accepted by the criminal court.
Gliwitzky cannot say whether this will happen in the Bromme and Kreidl case, but it does indicate that it is rather unlikely.

The situation is similar when it comes to the question of whether there will be a new appeal by the public prosecutor's office or the accused or their defense counsel.
According to Gliwitzky, the deadline for this ends one week after the verdict was announced, to be precise next Wednesday at midnight.
If the judgment is not appealed by then, it is final.
The starting signal for the probation process - combined with the request to the accused to start said community hours promptly.
