The EOC stated that the claimant of the case, who was originally employed as a project manager, was diagnosed with COVID-19 after working a few days and needed to be hospitalized for treatment.

While in hospital, the claimant received a phone messenger message from the respondent (i.e. former employer) that he had been dismissed for contracting COVID-19.

Law makes it illegal for bosses to fire employees based on disability

According to the Disability Discrimination Ordinance, it is an offence for an employer to dismiss an employee on the basis of a disability.

In this case, the employee's disability meant that he had contracted COVID-19, and the EOC brought legal proceedings in the District Court on behalf of the claimant under the Ordinance.

This is the second time that the EOC has brought a case of disability discrimination related to COVID-19 to the court, hoping to enhance public awareness and remind employers that disability discrimination in the workplace is illegal and not to take unnecessary measures against confirmed cases.

The EOC reiterates that the fundamental principles of anti-discrimination will not change during this period, even if the public health situation is constantly changing due to the pandemic.
