The government requires civil servants to sign a declaration of support for the Basic Law and allegiance to the SAR.
A senior environmental protection inspector repeatedly signed the four-character "Sunshine Sunshine" in the statement, and was accused of failing to properly sign and return the civil servant sworn statement before the deadline.
After he was ordered to retire early in September last year, he applied for a judicial review. The judge issued a judgment today (24th), stating that the senior environmental protection inspector's justification was not reasonably arguable, and he refused to grant a judicial review. License and require the applicant to pay the respondent's costs.
The applicant is Hu Deyan (transliteration) and the respondent is the Secretary for the Civil Service.
The applicant put forward a number of reasons, including that the Administrator's decision was unreasonable, and the applicant's statement should be deemed to be properly signed; the Administrator's decision was also illegal, and the Administrator did not list the requirements for signature in advance.
Emphasize that statements are serious business
The judge said in the judgment that making a statement is a serious matter.
As the respondent pointed out, whether it is a signature "I disagree" or "I support the government", the signature will not be accepted.
The judge agreed that the same would be true if someone else's name was written, such as Mickey Mouse or Donald Trump, or other slogans.
The sun shines like a slogan
The judge went on to point out that "the sun shines brightly" was the last words of the Song Dynasty general Yue Fei before his death.
It's not a name or a signature, it's more like a slogan.
After the applicant was refused to sign the first declaration, he did not correct his practice, but continued to write the same words in the other two declarations, and did not return the properly signed declarations before the deadline.
