What happens next with the landscape protection areas in the district of Miesbach?

The district parliamentary group of the Greens has a clear opinion on this: It demands more transparency from the district office.

– Disappeared original maps, an unrecorded decision: The recent history of the landscape protection areas in the district of Miesbach can certainly be described as turbulent.

With the result that the district office sees the validity of the protected areas at risk and has therefore initiated a procedure for legal security (we reported).

The district parliamentary group of the Greens cannot understand this path - and is now demanding extensive clarification of all the events mentioned.

Even when it comes to the cause of the latest evil, opinions differ.

"Just because of an incorrect protocol, an entire regulation including cards does not necessarily become invalid," wrote parliamentary group spokesman Thomas Tomaschek and his deputy Cornelia Riepe in a press release.

Consequently, in their eyes, there is no need for a new version of the corresponding district council resolution from 2019. The Greens raise two other questions: How did this formal error come about in the first place?

And how could it actually happen that the original maps from the 1950s disappear from both the district office and the government of Upper Bavaria?

"All of this must be researched transparently," Tomaschek demands when asked by our newspaper.

Greens demand transparency in the process

The Greens also want more transparency in the most recent procedure, with which the district office tried to reconstruct the decision made in 2019 and thus make it legally secure again with evidence.

As reported, the authority wrote to all 65 participants in the meeting at the time and asked for a statement.

But without success.

As the authority recently announced, the gathering of evidence was unsuccessful.

The district council would have to vote again on the protected areas.

The Greens can understand neither this result nor the way to get there, they emphasize.

"All the indicators and documents known to us indicate that a vote was also taken on this passage." The group members explained this in their statements.

It is also unclear to the Greens which criteria were used to decide whether the evidence was successful or not.

The district office has not yet answered a written catalog of questions from the parliamentary group from March 30th.

Appointment for a meeting with District Administrator Olaf von Löwis

In order to increase the pressure, the Greens have now asked for an appointment with District Administrator Olaf von Löwis - and they got it.

Tomorrow, Wednesday, three faction members will exchange their views with Löwis and the responsible lawyer at the district office, Tomaschek announces.

And at the same time make sure that the revised maps, which for example are lightened by the plot of the planned Vitalresort am Schliersee, may not serve as a basis for the new vote – as recommended by the administration.

The concern of the Greens is clear: the landscape protection areas must be preserved in their previous extent.

"A change may only be made as before in a regulated procedure in particularly justified cases."
