The 14-year-old girl was drunk after playing with her friends. She was sent home by her boyfriend and two young people who had just met. The two men were suspected of taking her boyfriend downstairs to buy drinks. During the period involved, they gang-raped the girl without using a condom.
After the girl woke up, she told her boyfriend that she had been violated, but the boyfriend responded, "No way, it's my second uncle." He also pointed out that the girl's boyfriend had only left the unit for 7 minutes, questioning whether it was enough time to complete what the girl claimed happened.
The jury in the High Court today (24th), after deliberation, found both men guilty of rape. The judge adjourned the case to July 13th for sentencing.
Two defendants: Zheng Honghao and Yuan Haochen (both 18 years old at the time of the incident), each charged with one count of rape.
The charge alleges that the pair raped a then 14-year-old girl X in Tin Shui Wai on April 16, 2019.
Alleging boyfriend was raped when he was taken away
When the victim X made a statement to the police for the first time, she said that she and her boyfriend had played poker "Blackjack" with other friends that night, and drank multiple cups of "Black Label" whiskey ditch green tea. She was drunk and vomited. The defendants "San Jing" (the first defendant) and "Chen Zai" (the second defendant) were sent home.
They also put the victim on the bed in her room.
She pointed out that the second defendant asked her boyfriend to go out to buy drinks, and then the second defendant entered the room and asked her, "Are you disturbing?" and then raped her.
X pointed out that she mentioned the incident to her boyfriend afterwards. The boyfriend said, "I guess Chen Zai is doing something in the house." He also said, "No way, it's my second uncle." X later broke up with her boyfriend and reported the case.
The first defendant was mentioned in the second video
She did not mention the first defendant's participation in the first confession, and did not mention that the other defendant had raped her until the second video interview with the police, explaining that she felt "faceless" and "faceless" because she felt violated by the two. It was embarrassing that the first defendant was not mentioned in the first videotaped interview.
Police later inspected the victim's room and found that the pillowcases and mattresses in her room had sperm stains believed to be from the two defendants.
The defense claims that the victim has no other evidence to rely on
When the defense cross-examined X, it pointed out that after everyone sent X home, the three men watched pornographic clips on X’s sofa on their mobile phones, and then someone entered X’s room to “jerk off” (self-blame), but no one raped them. X; the counsel representing the second defendant also pointed out that X has no evidence to rely on except for the sentence "Qudi has done it", and another lawyer pointed out that according to the CCTV footage, X's boyfriend just left the unit for an appointment 7 minutes, questioning whether it was sufficient to do what X claimed the two defendants had done, deeming X's claims unreliable and untrustworthy.
X said that she did not know that the defendant had committed suicide, but stressed that she was "awake" from time to time being raped by the two defendants, and she also struggled.
In directing the jury, the judge pointed out that there are differences between X's videotaped interview and the statement in court, and the jury can consider these differences in deciding whether X is a credible witness.
