From June, the refugees from the Ukraine will receive Hartz IV instead of asylum benefits. It is an immense challenge for the administration.

Bad Tölz-Wolfratshausen – As of June, the Ukrainian war refugees are no longer subject to the Asylum Seekers Benefits Act, but rather to the rules of the Social Security Codes.

The job center is then responsible for them, as it is for every other Hartz IV recipient.

This so-called legal change is a challenge – for everyone involved.

District administrator Josef Niedermaier and social department head Theresa Deselaers described the hurdles at the meeting of the district committee on Monday.

"Administratively, this is a tour de force," said Niedermaier.

Normally something like this would have to be prepared for months.

“We have to pull this off within a few days.” One of the main problems: “Anyone who is registered with us and has an account will receive benefits from June.” And registration is not just about filling out any forms.

“Everyone has to be treated by the identification service.

Submission of a fingerprint is a prerequisite for the residence permit," said Niedermaier.

Only the police are allowed to take fingerprints of the refugees

There are four stations in the district where fingerprints can be taken: three are in the police station and one in the district office.

"But it can only be operated by a police officer," said Niedermaier.

The district office would have to request it.

"But we know what our police have to do here," said the district administrator, also with a view to the preparations for the G7 summit in Elmau.

The need has now been reported to the government of Upper Bavaria.

"But we don't know if we can do it quickly." Reiner Berchtold (SPD) was confused: Such fingerprint scanners are available in every residents' registration office.

However, these could not be used to register war refugees, Deselaers replied.

"It's a different system."

Transitional period through fictional certificate

But there are transitional periods, the department head reassured.

Once the refugee is registered, the Immigration Office issues a so-called fictional certificate.

“Ultimately, the certificate says that all the documents are there and that perhaps only the identification service is still pending.” Fortunately, the requirement that only the official forms of the Bundesdruckerei may be used for the certificate no longer applies.

In the first districts, they are no longer available, said Deselaers.

Anyone who arrives after June 1st must be registered immediately

The refugee – 1,545 are currently living in the district – presents the fictional certificate to the job center and then receives Hartz IV. This applies at least to everyone who came to the district before June 1st.

"Everyone else must be registered immediately," said Deselaers.

But that only works if a fingerprint station is in operation and if the person concerned “can identify himself sufficiently”.

In other words, he has an identity document that is not only written in Cyrillic.

Anyone who does not have that first gets a Duldung – and receives asylum benefits instead of Hartz IV. “We only know how many people fall into which area on May 31,” said Deselaers and admitted: “It’s all very hoppladihopp.”

How is double payment of benefits prevented?

Klaus Heilinglechner (FW) was skeptical about this complicated process.

Asylum benefits are currently being paid out by the municipalities.

"How do we make sure that we don't pay twice?

So how do we know who is receiving Hartz IV?” asked the mayor of Wolfratshausen.

The transmission of the data to the municipalities is not possible.

Therefore, everything will go through the district office in June.

"Anyone who comes with a fictional certificate, we send to the job center," the rest will receive temporary asylum benefits.

“On June 1st, however, payments will be made to our 'normal' asylum seekers.

From June 2nd, the Ukrainians are welcome to come,” says Deselaers.

Bank account is a requirement for payment

Whether everyone will have an account by then - the job center does not pay out in cash - is an open question.

The Sparkasse Bad Tölz-Wolfratshausen should be the contact point for many.

"So far we have opened almost 300 accounts for Ukraine refugees," said spokesman Willi Streicher.

A Ukrainian passport or ID card is required for this.

“It is important that those interested can communicate with us – preferably with an interpreter if their language skills are not sufficient.” It would also be helpful to make an appointment.
