Deputy defense of the severity of Lieutenant Rom Abergil's sentence rejected • Military tribunal raises the season to 28 months


The Military Court of Appeals today (Wednesday) accepted the appeal of the military prosecution regarding the punishment of Lieutenant Rom Abergil who was convicted in dozens of cases of secret photography of women, including IDF servicemen in compulsory service and a sentence of aggravated punishment. 

The tribunal increased the sentence to 28 months 'imprisonment for actual execution, instead of a sentence of 18 months' imprisonment handed down by the district military tribunal.

In addition, the officer was given a suspended sentence, demoted to the rank of private and compensation to the victims of the crime.

The verdict stated that in his actions, the officer suffered significant and widespread damage to the fabric of life in the army, the trust of servants in each other, the soldiers' trust in commanders and the public's trust in the IDF.

"In the case before us, the consideration of rehabilitation in the appellant's case does not tip the scales and does not justify deviating from the scope of the appropriate sentence determined by us. Purely, "the verdict read.

"Although it seems that these feelings are mainly related to exposing his actions to the public and harming his image in the eyes of others, with a limited ability to feel empathy for the victims and the consequences of his abusive actions towards them." 

Abergel served as an officer at the Tze'elim base in the south of the country.

He was convicted of twenty-eight incidents in which he photographed female soldiers without their knowledge, and a number of other incidents of indecent acts against female soldiers.

"The IDF takes any case of sexual assault seriously, and will continue to act decisively to bring to justice anyone who fails in these acts among his servants," it said.
