Now a man from Diessen, who attacked an elderly woman while intoxicated with drugs and threatened her death, has been convicted.

Wessobrunn – Dießener (34), who severely attacked a Wessobrunnerin (87) on her terrace (we reported), received a two-year suspended prison sentence for willful intoxication.

The district court of Munich II also sent him to a rehabilitation center – also on probation.

According to the conditions, he is no longer allowed to consume drugs and has to go to the forensic ambulance in Haar at least once a month and also be visited at home.

Only then can he remain at large.

Defense attorneys pleaded for acquittal

The public prosecutor had demanded a prison sentence of two years and nine months and placement in rehab.

The defenders had pleaded for acquittal - the total intoxication was neither intentional nor negligent, because the Diessener had not had any bad experiences in 14 years of smoking cannabis, only "chilling" experiences.

They also refused rehab because he no longer had any addiction to drug use.

However, the court saw things differently.

The whole thing works "only so well with abstinence control by the forensic ambulance," emphasized the presiding judge Thomas Bott.

Therefore, he imposed the probation only under appropriate conditions.

These are essential.

Elderly brutally attacked and injured

It is true that the man from Diessen was no longer in control of his senses during the drug intoxication and was therefore not responsible.

An attempted homicide was ruled out.

Nevertheless, a conviction was possible because he intentionally intoxicated himself and then committed a criminal offense while incapacitated.

The employee from Dießen had smoked a joint in a friend's allotment garden in his hometown on the evening of May 8, 2020.

The following evening he consumed a second.

One day later, on a beautiful Sunday, he rode his bike around Wessobrunn and smoked cannabis again.

This put him in a psychotic state.

As he cycled past the home of a former teacher at around 7 p.m., he fantasized that she was a witch.

He ran through the garden gate to the 87-year-old lady sitting on the terrace and suddenly hit her.

During the attacks, he kept shouting, "You old witch.

I'll take you now."

On the witness stand, the elderly woman reported that the 34-year-old grabbed her by the jacket, pulled her off the terrace and "continuously boxed and kicked her with both fists".

She boxed back and tripped the man.

She used the time while the attacker got to her feet to drag herself to the front door.

When she looked into the Diessener's eyes lying in the entrance to the house, it was clear to her: "He's killing me." He seemed like a "wild animal" that she would "slaughter with relish".

However, the sprightly lady managed to step after the attacker, slam the door and lock it.

It continued like in the film: the accused kicked the front door and smashed the glass of the woman's door with his crutches.

The 87-year-old hid in a chamber.

Meanwhile, startled neighbors rushed to help.

The attacker vehemently defended himself against his arrest by the police, slightly injuring one police officer and spitting on another.

Officers also found three bags of tobacco and marijuana on him.

The senior suffered a craniocerebral trauma and a broken nose, which have healed again.

However, she still suffers from psychological consequences, such as insomnia.

At the start of the trial, the defendant had his defense counsel informed that he "assumes responsibility".

In his last word he said that he was very sorry.

He paid a deposit of 2,000 euros to make amends.

The verdict is not yet final, which means that both sides – the public prosecutor and the defense – can still appeal.
