Danger to the general public: Regional court in Regensburg sends 53-year-olds to psychiatry

This decision by the Regional Court of Regensburg in the manslaughter trial against the 53-year-old is no surprise.

Like Wirtz, the jury board is convinced that Jakob T. was no longer in control of his senses at the time of the crime due to this flare-up - and therefore not guilty.
Apart from the medical forensic findings on the numerous injuries, the fact that he was incapable of being guilty due to illness is one of the only things that the Chamber was able to determine with certainty.

On that Tuesday, the later victim was still alive and called his sister at 7 p.m. sharp, as he did every evening.
But because she was still at work, she missed the call and the brother spoke on tape – where she has recorded his voice to this day.
Jakob T. didn't come to work on Wednesday.
When the social worker wanted to come by the next day, like every Thursday, to cook together in the assisted-living community, nobody answered her bell.
There were calls around, with the job, with the BKH - whether the men had probably made representations there themselves again.

When a supervisor tried again in the flat share, Jakob T. finally answered.
The witness claims to have heard one word: "dead," repeated Hammer in a calm tone.
A little later, the notified police officers found the body in the apartment.
Jakob T. was apparently asleep in his room.
"As far as we know, there was no reason for the killing," Hammer sums up.
Despite the difficult situation in which both men grew up and the illness affecting them, "the world of the two of them was probably fine in 2021".

Jakob T. was arrested immediately and temporarily taken to the BKH, where he will remain in the future.
Because the district court sees him as a danger to the general public.

No one can say with certainty whether Jakob T. – if he were not accommodated – would not again seriously injure or kill someone.
Because of his illness, he can't do it himself.
"We hope that you will succeed in improving your condition," Hammer said, addressing Jakob T.
He accepted the verdict immediately and left the courthouse on the fourth and last day of the trial in shackles and in the police car in the direction of the BKH.
