François d'Orcival: "In Bayonne, a highly politicized examining magistrate"

CHRONICLE - The magistrate in charge of the investigation into the assassination of a bus driver, who had moved the whole of France, reclassifies the facts downwards.


The subject had disappeared from the campaign.

But not from the judges' office.

It can also come out.

The case dates back to July 5, 2020 and took place in Bayonne.

Alerted by the agitation that reigns in his bus, his driver, Philippe Monguillot, wants to check that several individuals boarded have their tickets.

They rush on him and lynch him.

He sits up, takes a final blow to the face and collapses.

He died five days later in hospital.

At the end of his investigation, the prosecutor of the Bayonne prosecutor's office considers that it is an

"aggravated voluntary homicide"

of a public transport driver.

This sends the case to a court of assizes.

But the investigating judge has just decided otherwise: he requalifies it and specifies, taking up the opinion of the lawyer for one of the two attackers, that the qualification of murder does not hold, that if there was man's death, this was done

"without intention of giving it".
