Journalists will be able to request and possibly obtain copies of precautionary orders no longer secret "albeit with a series of limits" from the Perugia Public Prosecutor's Office, first of all the protection of privacy.
This is established by a detailed provision by the head of the Raffaele Cantone office which refers to the need to "guarantee the correct exercise of the right to press", guaranteed "by Article 21 of the Constitution".
The deed refers to notes from the Attorney General at the Court of Appeal of Perugia and the Cassation regarding information and criminal proceedings.
It is therefore underlined that both considered "a legitimate interest of journalists in obtaining copies of procedural documents no longer covered by secrecy,"
the dissemination of the documents.
That "must not entail - it is emphasized in the provision - the communication of sensitive data or news or images potentially harmful to the dignity and confidentiality of the victims and offended persons of the crimes, even more so in the case of minors".
"The recognition of a certainly protected interest on the part of the journalist in requesting and obtaining a copy of the precautionary order - Cantone writes - certainly cannot mean that he is the holder of a full subjective right to release, since, on the contrary, it must be held that it must be balanced with the need to protect other interests and, therefore, certainly encounter limits, even if less than those concerning requests for copies of other types of non-secret procedural documents ".
