The district court has acquitted a 38-year-old Miesbacher who was accused of not paying rent.

Because he is said not to have paid the rent for two apartments for several months, a 38-year-old from Miesbach now had to answer to the district court.

The public prosecutor has accused the 38-year-old Miesbacher of fraud as an accomplice in two cases and forgery of documents.

Thanks to the testimony of his wife, the trial ended lightly for the accused.

The public prosecutor had nevertheless asked for a conviction.

Previous landlord certificate forged

The first rental property was an apartment in Miesbach, in which the accused lived with his wife in 2016 and 2017.

The two are said to have owed eight months' rent.

Damage to the owner: more than 8600 euros.

In Feldkirchen-Westerham, where the couple moved into an apartment in March 2019, payments of 2550 euros are said to have failed.

In addition, the duo sent the landlord in Feldkirchen-Westerham a previous landlord's certificate with a forged signature before moving in, as the public prosecutor's office alleged.

Allegations that amazed the 38-year-old.

"I didn't know anything about all this, my wife did it all," the Miesbacher opened his statement.

I didn't know the content of the previous landlord's certificate.

"I only found out from the police that it was fake." Regarding the rent payments, the man explained that he and his wife were quite solvent.

"I set up a standing order." Apparently, his wife repeatedly stopped payments "to plug other holes".

He never looked at bank statements.

"My wife took care of the finances."

Woman relieves the accused

There was a first discharge from the landlord of the Miesbacher apartment.

"I had almost nothing to do with him," said the 43-year-old on the witness stand.

The communication took place "mainly with his wife".

The wife (43) also testified in court and admitted what her partner was accused of.

"My husband has nothing to do with all the crimes, that was all I did." A court case against her has already been finalized.

The woman also confirms that she has repeatedly deleted the standing order.

She justified her actions with purchase debts.

Despite the exculpatory statements, the public prosecutor's office demanded a suspended sentence of 13 months and payment of two net monthly salaries.

Judge Walter Leitner did not play along and acquitted Miesbacher.

The couple now have separate accounts.
