However, he is alleged to have failed to follow the request of the Electoral Affairs Commission to upload the supporting consent form on the central platform of the REO within 1 day of publication, and these consent forms were uploaded later.
Li Jiachao filed a petition with the High Court yesterday (7th), requesting immunity from punishment.
The applicant is Li Jiachao and the respondent is the Secretary for Justice.
Li said in the complaint that the three election advertisements on April 13, 17 and 18 this year did not provide three copies of the supporting consent within one working day after they were published.
Li is now asking the court to issue an order exempting the applicant from complying with the relevant requirements and exempting the penalty under Section 87(9) of the Election Procedure (Chief Executive Election) Regulation.
Li also asked the court not to make a costs order for this application.
According to section 87(9) of the Election Procedure (Election of the Chief Executive) Regulation, violation of the relevant provisions is punishable by a fine of $5,000 and imprisonment for 6 months.
