The Ombudsman for Public Complaints against Judges, Judge (retired) Uri Shoham, publishes today (Wednesday) the annual report for 2021. According to the report, last year the Commission received 903 complaints about judges and judges and 946 decisions were given.

About 40% of the complaints were rejected outright, but of those investigated by the Commission, 43 justified complaints were found and 55 complaints ended with a remark to the judge or the judge.



Many complaints have dealt with improper conduct on the part of judges.

"With all the understanding of the considerable burden placed on the judges' shoulders," the commissioner added, "this does not justify such conduct that has the potential to harm the status of the court and public trust in it. Another complaint received was that of an inmate serving several life sentences for the murder of his children, who lamented the deterioration in his mental state because of a remark by a judge who discussed the inmate petitions he had filed.

According to the prisoner, his mental condition worsened after the judge said the sentence "to enter the mind of the petitioner who did what he did", and the commissioner found the complaint justified.

"Such a statement is unnecessary and may harm, unnecessarily, the complainant while the offenses for which he was convicted are not at all relevant to the decision on the petitions he filed."



Other complaints dealt with the continuation of proceedings, such as the issuance of a judgment a year after the summaries, in a case opened six years ago.

In another case, a woman complained that only ten minutes were allotted for a hearing in the small claims court - and her complaint was found to be justified.

The commissioner referred to complaints about cases published in the media, such as a hearing on extending the detention of a young Arab from East Jerusalem who was arrested after photographing a border policewoman in the Old City in a way that could, according to police, be interpreted as sexual. In response to the complaint, the judge said that in retrospect, and after further examination, it was clear to him that the wording he used was far-reaching and completely incorrect, and that he had to formulate more carefully and clarify his intention regarding the content of the words that accompanied the video. A place to avoid using the word "flattering", which has a positive connotation that does not fit at all in describing the meaning of the text that accompanied the video.



The Commissioner ruled in his decision that in view of the nature of the decision given by the judge and according to the context of things, the word "flattering" constitutes an unnecessary addition, and it was possible to be satisfied with the conclusion that the publications are not offensive.

However, in light of the words of remorse and apology expressed by the judge, and the criticism that the appellate court made of his statement, the Commissioner found that in this comment the clarification of the complaint was exhausted.

The Commission also received complaints about the Rabbinical Court - including a complaint about the Chief Rabbi of Israel, Yitzhak Yosef, who serves as a judge in the Great Rabbinical Court.
