The Bordeaux public prosecutor's office appealed a judge's decision which would allow Romain Dupuy, author of the murders of two caregivers in Pau in 2004, to be transferred from a Unit for difficult patients (UMD) to a conventional psychiatric hospital , the prosecution told AFP on Friday, June 10.

This appeal against an order of the judge of freedoms and detention (JLD) will be examined on June 15 before the Bordeaux Court of Appeal.

"The prosecution appealed this decision, which includes, according to our analysis, a difficulty as to its motivation on the part relating to the lifting of the placement in UMD", explained to AFP the public prosecutor of Bordeaux Frederique Porterie.

The Gironde prefecture has also announced its intention to appeal.

At the end of 2007, Romain Dupuy, suffering from schizophrenia, had been recognized as criminally irresponsible for his actions and had not been tried for the stabbing murders at the Pau psychiatric hospital center of a nursing assistant and a nurse whom he had beheaded.

The 39-year-old man has been placed since 2005 in complete hospitalization without consent at the UMD in Cadillac (Gironde), despite regular requests for his transfer to a conventional psychiatric hospital in recent years from his lawyers, against the opinion of the authorities.

"A major reversal of jurisprudence"

In her order consulted by AFP on Thursday, the liberty and detention judge (JLD), who verifies every six months that the internment regime for psychiatric patients without consent is in line with their mental state, considered that the placement of Romain Dupuy in the Unit for difficult patients “became irregular” and ordered its lifting.

"It is constant and medically established that Mr. Romain Dupuy is no longer currently hospitalized in UMD", also estimated the judge, who requested that "the person concerned be kept in full hospitalization" outside UMD.

“This ordinance constitutes a major reversal of case law.

It finally establishes a real control of the judicial judge, in this case the JLD, on the measures of care without consent in the UMD”, had reacted Thursday Hélène Lecat and Serge Portelli, the lawyers of Romain Dupuy.

According to them, this decision "is part of the constant evolution of the law in this area after the recognition of the need for the intervention of the judicial judge to control henceforth the isolation and restraint of patients placed in psychiatry".
