Capaci bis, Cassation confirms the four life sentences

The Supreme Court confirmed the 4 life sentences issued in the bis trial for the Capaci massacre against Salvatore Madonia, Lorenzo Tinnirello, Giorgio Pizzo and Cosimo Lo Nigro.

The Supreme Court also confirmed the acquittal of Vittorio Tutino.

The verdict was issued by the II Criminal Section.

The Pg of the Cassation Delia Cardia asked for confirmation of the 4 life sentences issued in the bis trial for the Capaci massacre against Salvatore Madonia, Lorenzo Tinnirello, Giorgio Pizzo and Cosimo Lo Nigro.

The Pg Cardia asked for the annulment of Vittorio Tutino's acquittal and a new encore appeal against him.

In the evening the stoats of the Second Criminal Section should deliver the verdict.

The Pg Cardia underlined the unitary massacre strategy of the Cosa Nostra and requested the validation of the sentence issued by the Court of Assizes of Appeal of Caltanissetta on 27 July 2020, with the exception of the part concerning the acquittal of Tutino also established in the first degree.

In the Capaci massacre of 23 May 1992, judge Giovanni Falcone - who at the time was head of the Criminal Affairs of the Ministry of Justice - died killed by the Cosa Nostra, his wife Francesca Morvillo, also a magistrate, and the agents of the escort Vito Schifani, Antonio Montinaro and Rocco Di Cillo.

 "Already in 2000 there was a first sentence that had hypothesized the unitary design of the Cosa Nostra in the massacre attacks on the continent and in the Sicilian attacks of Capaci and Via D'Amelio", and sharing this approach proves to be "correct" the reasoning followed in the appeal sentence of the Capaci bis trial.

Pg Cardia highlighted this in his indictment.

 PG: 'NEW TRIAL FOR TUTINO, WE MUST DO IT FOR THE VICTIMS'

"Tutino's acquittal follows a completely façade path" in which "there was no analysis of the procedural emergencies" which indicate Tutino "as Graviano's trusted man, a mafia soldier active in a unitary subversive program".

This was underlined by the Pg of the Cassation Delia Cardia in her indictment before the Second Criminal Section during which she requested the annulment of Tutino's acquittal.

In his opinion, the appeal verdict of the Caltanissetta judges "is wavering on the evaluation of Spatuzza and does not enhance the fact that Tutino was in the firing group", according to the Pg moreover the acquittal of Tutino "highlights a total fall in logic. in the method used by the Court of merit "and a new trial against him"
