President al-Assad issues a law enabling technical institutes to function as manufacturing and production centers

Damascus-SANA

With the aim of developing the foundations and standards of training and production in technical institutes and to keep pace with developments in the labor market, President Bashar al-Assad issued Law No. 25 of 2022 regulating the mechanism for taking technical institutes as production centers to replace Legislative Decree No. 39 of 2001.

The new law allowed technical institutes to manufacture and sell machines, tools and equipment, contract with the business sector to train, manufacture products, carry out repairs and various services, and sell products of training exercises implemented during the academic year.

Below is the text of the law:

                                          Law No. 25

President of the Republic

Based on the provisions of the Constitution.

And what was approved by the People’s Assembly in its session held on 10/22/1443 AH corresponding to 5/23/2022;

It issues the following:

Article 1 - Subject to the provisions of the local administration law, the competent minister may, after the approval of the Supreme Council of Technical Education, take the technical institutes as production centers and allow the institutes to engage in the following activities in whole or in part:

A- Manufacture and sell machines, tools, equipment and other products within its competence in accordance with the provisions of the laws and regulations in force without affecting the implementation of the prescribed curricula.

b- Contracting through the public authority to which the Technical Institute belongs with the business sector on training, manufacturing products and carrying out repairs and various services within its competence.

C- Selling the products of training exercises implemented during the academic year at a price determined according to the principles and rules specified in the executive instructions.

Article 2 - The Higher Council for Technical Education, in coordination with the Minister of Finance, shall issue a resolution specifying the basis for distributing revenues resulting from production, maintenance and service contracts, taking into account the payment of the cost value to the public treasury, and the net profits shall be distributed according to the following:

A- 50% Fifty percent incentives and rewards for employees, supervisors of production and services work, and for students participating in production.

B- 50% (fifty percent) to develop the production process according to the following:

1- Contributing to the purchase of machinery, tools, equipment, training and production requirements for the Institute.

2- Contributing to the payment of maintenance fees for machines and tools at the Institute.

3- Contribute to securing the supplies and expenses necessary for the implementation of the works participating in the local and central exhibitions.

C- The surplus of profits shall be revolved in the fiscal year for the following fiscal year.

Article 3 - A bank account shall be opened for each institute that undertakes production, training, repairs and services in whole or in part. It shall be moved by the competent minister or his authorized representative, and the following shall be deposited in it:

A- Revenue from production centers.

b- Gifts and donations in accordance with the laws and regulations in force.

C- Any revenues permitted by the laws and regulations in force.

Article 4 - By a decision of the competent minister, it is permissible to open halls for displaying and selling products of practical training in institutes.

Article 5 - It is permissible by a decision of the Minister of Finance based on the proposal of the competent minister to grant the institutes participating in the production an advance from the funds of the public treasury, with a maximum limit of 100,000,000 SYP, one hundred million SYP, to be paid in cash in accordance with the laws and regulations in force.

Article 6 - The incentives and rewards contained in this law are not subject to the ceilings of incentives and rewards stipulated in the laws and regulations in force.

Article 7 - The executive instructions necessary to implement the provisions of this law are issued by a decision of the Supreme Council for Technical Education.

Article 8 - Legislative Decree No. 39 of 2001 is repealed.

Article 9 - This law shall be published in the Official Gazette.
