The Bordeaux Court of Appeal refused Friday, June 17 the transfer to a classic psychiatric hospital of Romain Dupuy, murderer of two caregivers in Pau in 2004 and placed in Unit for difficult patients (UMD).

The court, requested on appeal by the Bordeaux public prosecutor's office and the Gironde prefecture against an order from the judge of freedoms and detention (JLD), considered that the latter was not competent to order the release of the placement in UMD of Romain Dupuy, 38 years old.

Four favorable reports

Declared criminally irresponsible in 2007 due to a chronic psychotic disorder of a schizophrenic nature, "

currently stabilized by medical treatment

" according to the court ruling, Romain Dupuy had not been tried for the stabbing murders of a caregiver and a nurse, whom he had beheaded, at the psychiatric hospital in Pau.

Since 2005, he has been placed in complete hospitalization without consent at the UMD in Cadillac (Gironde), despite several recent requests for transfer to a conventional psychiatric hospital from his lawyers.

He has been the subject of four favorable reports from a medical monitoring committee since 2018, without the prefecture following these opinions with a release measure.

In 2018, the administrative justice seized by his lawyers had considered that the request to order the prefecture to issue an order, in this case to lift its maintenance in UMD, fell within the jurisdiction of the JLD.

The latter verifies every six months that the regime of internment of psychiatric patients without consent is in line with their mental state.

“Become irregular”

At the beginning of June, this judge had for the first time considered that the placement of Romain Dupuy in UMD had "

become irregular

", ordering his lifting.

But the Court of Appeal, called upon for the fourth time in this case, considered on Friday that the rules relating to the organization and conditions of admission to UMDs were inserted in a part of the public health code not falling under within the competence of the JLD.

In the absence of a law giving jurisdiction to the JLD in the matter, writes the court in its judgment, "

only an appeal on the merits against the implicit decision to reject the transfer request taken by the prefect (. ..) can be initiated by the patient

” before the administrative justice.
