Only 8.80 euros per square meter: Thaddäus Spegel (65) makes his tenants happy with such prices.

But these numbers are a thorn in the side of the tax office.

The officials recently imposed a tax audit on the people of Oberhaching.

Result: The fair landlord should pay more than 40,000 euros!

Munich - "That's absurd," says Spegel.

He has more than 100 apartments in Munich - and specifically asks for prices that are below the rent index.

“Some tenants have lived in my apartments for 30 or 50 years.

It's important to me that they feel comfortable - and treat my property well," says Spegel.

Prices between 12.50 euros and 13.50 euros per square meter are usual for him anyway.

The average in Munich is around 20 euros per square meter - hardly affordable for many.

All the more important that there are landlords like Thaddäus Spegel.

The special feature in his case: He also has employees who look after his apartment buildings and at the same time are tenants with him.

“They partially completely prepared the apartments, installed floors and kitchens.

That's why I ask even less of them," says Spegel.

In one case, for example, the price is 8.80 euros: the tenant pays around 540 euros for 61.28 square meters in Hansastrasse.

"But the tax office wants me to charge 1236.17 euros," says Spegel.

So 20.17 euros per square meter.

"But the calculation makes no sense from my point of view."

Because: Legally, this is about the assessment of a pecuniary advantage for the tenant, which should also be taxed.

"An absurd regulation that must be abolished," says Rudolf Stürzer, chairman of the owners' initiative Haus und Grund Munich.

"The state must be happy that an employer provides affordable housing for its employees," says the lawyer and demands: "One must not additionally fleece a landlord."

The tenant association sees it similarly.

"It is unacceptable that fair landlords are also being punished," says Volker Rastätter, the public relations officer.

Landlords have to pay tax on their income.

Here, however, the expenses are still deducted as income-related expenses.

The problem: "If a landlord demands less than half of the rent according to the rent index, the tax office only partially recognizes his income-related expenses, for example for maintenance, repairs and depreciation," says Stürzer.

This often happens to private landlords with old, long-term tenancies.

As with Thaddäus Spegel, who is now said to shell out more than 40,000 euros.

In cases like these, according to the tenants' association, the only option is to take legal action.

Anger about too cheap rents: That's what Munich industry experts say   

“Paragraph 21, paragraph 2 of the Income Tax Act stipulates that the income-related expenses must be fully deducted even if the landlord only charges 50 percent of the local comparative rent from his tenants,” explains Volker Rastätter from the Tenants’ Association.

If the landlord demands even less, he may only deduct the income-related expenses proportionately: At 40 percent rent, only 40 percent of the income-related expenses.

There are often disputes with the tax office about how the local rent is to be calculated.

But: "The Federal Finance Court has decided several times that the lower value should be used for the local comparative rent, if a rent index is available."
