Precedent: The Jerusalem Municipality will assist in the payment of building management fees Israel today

The municipality has decided to grant the developer a full exemption from the improvement levy, provided that it finances the maintenance fund in the urban renewal project.

Apartment owners in urban renewal projects are often faced with a difficult dilemma as the management fees ("house committee") in the new building increase significantly with the construction of the new building, and some tenants have difficulty meeting payments.

Management fees can jump from tens to hundreds of shekels a month, and sometimes stand at more than a thousand shekels. 

"Urban renewal is first and foremost people," says Adv. Dan Halpert, who specializes in representing apartment owners in construction eviction and TMA 38 projects throughout the country.

"We talk all the time about entrepreneurs, municipalities, laws, taxes, national needs, earthquakes ... but above all urban renewal are the residents who live (usually for many years) in buildings that tend to fall whose systems are old and crumbling and sometimes even dangerous to live in. These residents are The basis and the essence of urban renewal and they must take care and help. " 

While the house committee fees paid by apartment owners in old buildings for minor maintenance - cleaning, replacing a burned-out light bulb and pruning vegetation - amount to a few tens of shekels, this is not the case in the new towers to which apartment owners are supposed to return at the end of the project.

These are already new buildings that include modern systems and complex infrastructure (fire extinguishing systems, garbage removal, elevators, water pumps and more) and the management is carried out by a management company.

The right way to help homeowners is to oblige developers to help pay management fees (by setting up a "maintenance fund").

The legislature has provided assistance only to apartment owners in their retirement age for a single apartment, however sometimes this is not enough. 

"The Jerusalem municipality saw fit to impose the maintenance fund payment on the developer and did so wisely," says Adv. Halpert,

This is proper and correct conduct.

It is correct to link the provision of the significant benefit to the developer (exemption from the improvement levy) by providing a significant benefit to the apartment owners.
