He punched her, choked her and threw a knife at her: a Miesbacher (34) attacked his wife for several years.

Now he has been convicted.

Hausham

– A Miesbacher (34) is said to have physically attacked his wife (32) several times.

Mostly within their own four walls in the apartment they once shared in Hausham.

In December 2021, the woman had enough, she reported her husband to the police.

Because of actions that happened several years ago.

The 34-year-old was now tried before the Miesbach district court.

Actions spanned several years

The charges were three counts of intentional bodily harm, attempted dangerous bodily harm and coercion.

The public prosecutor charged Miesbacher with the following crimes: In July 2018 he is said to have hit his wife in the face with his fist, so that she fell unconscious to the ground.

He poured cold water over her to wake her up.

In March 2019, the 34-year-old is said to have thrown a knife with a 15-centimeter blade at his wife, which she only just missed.

Almost a year later he is said to have choked her and threatened to shoot her in both knees if she did not come back to him from her parents.

The last accused case dates from August 2020. During a holiday together in Turkey, the Miesbacher is said to have hit the 32-year-old in the face with his fist.

The Miesbacher did not want to be held accountable for the actions he was accused of.

On the contrary.

"All allegations are false," he declared.

He admitted that there had been "loud arguments and sometimes crowds" between the spouses.

But nothing more.

"Why should she be married to me for twelve years if I'm such a bad person?" asked the 34-year-old.

Rather, he was the one who had a hard time.

"Your family didn't accept our marriage," he lamented.

He had explanations ready for the individual acts with which he tried to exonerate himself.

His estranged wife, however, confirmed the descriptions of the indictment.

She explained why she went to the police so late: "I was just so caught up in myself.

When I collapsed at home at the end of 2021, I decided to report him.” An officer from the Miesbach Police Inspectorate was able to understand this.

"She had no more strength and didn't dare before because she somehow wanted to keep the family alive," explained the 58-year-old.

Prosecutor: No remorse on the part of the accused

The prosecutor also considered the statement of the 32-year-old to be credible.

The statements of the defendant, on the other hand, are protective claims.

"On the photographs you can see clear strangulation marks and a black eye," stated the prosecutor.

She was particularly angry that the 34-year-old had no regrets.

She demanded a prison sentence of one year and eight months on probation and a fine of 2700 euros.

The defendant, who appeared without a defense attorney, stated "that I trust in the justice of the judge".

He does not believe "that the police officer acted as a neutral witness".

Judge Walter Leitner finally sentenced the man from Miesbach to eleven months' imprisonment on probation and a fine of 1,200 euros.

He justified his decision by saying "that I didn't see any motivation in the witness to make a false statement".

The judge said she could still remember the bad, traumatic experiences.

A physical altercation was always preceded by an argument.

So it was about “acts of affect” by the 34-year-old – “and they were really massive”.
