Arles: Emmanuel "de" Taché, an elected RN, sued for having appropriated a particle name

The new RN deputy for Bouches-du-Rhône, Emmanuel Taché de la Pagerie, is being sued by three descendants of the Tascher de la Pagerie family who accuse him of having appropriated their name by particle, said Wednesday the plaintiffs' attorney.

The latter fear seeing their surname tainted by the action of the elected official.

Born on February 20, 1975 in Montreuil, in Seine-Saint-Denis, under the name of Emmanuel Taché, the elected official uses the surname “de la Pagerie” as a username.

Asked by AFP, the Bouches-du-Rhône prefecture indicated that there was nothing to prevent him from running for the legislative elections with this username, confirming information from the daily Le Monde.

“The Cerfa administrative form from the Ministry of the Interior completed by all the candidates also included both their birth name and their usual name,” the prefecture told AFP.

"We have initiated an action for the protection of the patronymic name" before the judicial court of Nîmes, indicated for his part to AFP the lawyer for the plaintiffs, Me Frédéric Pichon.

A setting hearing (of the trial date) will be held on July 8.

The plaintiffs demand the cessation of the use without right or title of the name “de la Pagerie” by the new deputy of the National Rally under penalty of 500 euros per day of delay and the symbolic payment of one euro in damages.

"My clients from Normandy but living in Paris are the only heirs to bear this name since the death of their father in 1993. And the latter had, in his last wishes, expressed the wish that his name be protected", argues the 'lawyer.

RN, LFI, LREM, whatever

For Me Pichon, the fact that Emmanuel Taché has been using the names of his clients for years does not in any way cancel out their prejudice: “We did not know it and the affair has taken on a new dimension since his candidacy for the legislative elections and the publication of 'articles in the press, the publication of ballot papers and posters with the name of the Pagerie'.

“And now that he is elected, he will be required to intervene regularly,” he argues.

“Whether he is RN, LFI or LREM is not the problem.

It is about the public use of a patronymic name which is protected under French law", he explains, referring to "the rarity" but also "the prestige" of the name of his clients who count in particular in their lineage. Napoleon's wife, Joséphine de Beauharnais, born Marie Josephe Rose Tascher de La Pagerie.

There is "a significant risk of confusion in the eyes of the public", even if the spellings of the two names are different, he says.

Contacted by AFP, the new deputy did not respond to calls.

In an article in Le Monde, he explains that "de la Pagerie" has been "registered in his passport for thirty years", that he has just been elected and has "no time to lose with this kind of subject".
