The spokeswoman for the Greens faction in the Wolfratshausen city council announced that her faction would "again deal with the illegal constructions on the Isarspitz in Weidach".

Tammelleo is thinking of a "compromise solution", but says ahead of time: "The solution must really hurt the client."

As reported, the Bavarian state government has written a statement on the three illegal buildings in the Weidach district based on a petition from the owner.

The proposal of the CSU/Free Voters coalition: The city of Wolfratshausen could have a development plan drawn up for the properties at Isarspitz 24, 24a and 25, which are located outside - and thus legalize the illegal buildings afterwards.

As reported, Mayor Klaus Heilinglechner (Wolfratshausen Citizens' Association) has sounded out four out of five city council factions that would categorically reject this.

According to their spokeswoman, the six-member Green Group alone is ready to discuss the option.

The lower building control authority at the district office insists on the demolition of the three houses.

The owner should do this voluntarily by October 1st, otherwise he is threatened with a formal demolition order.

"The demolition would be absurd, a catastrophe," says Tammelleo, referring to the acute housing shortage in Loisachstadt and the "incredible waste of resources" that would be associated with the demolition.

In addition, one should not only look at this "bizarre story" through the legal lens, but also have to keep an eye on the human component (all three houses are rented).

Pity for the builder is “within narrow limits”

So that there is no misunderstanding: Your sympathy for the Geretsried client is "within limits", says Tammelleo.

He deliberately violated applicable law, to their knowledge not for the first time.

Now apparently "an example should be made".

But instead of the ultima ratio, the demolition of the property, a compromise solution must be found.

For Tammelleo (“that's my very personal opinion”) it could look like this: The city of Wolfratshausen legalizes the illegal buildings by having a development plan drawn up.

"And the client pays a fine of two million euros," emphasizes the Greens spokeswoman.

This sum is "certainly deterrent enough" to prevent imitations.

In addition, it would be ensured in the long term that the owner does not profit financially from his illegal activities.

Although the municipality rejected all planning applications for the said plots (the permit was granted by the district office in 2014), Tammelleo believes that the city has “a duty of care”.

The city “has a duty to try everything to settle the Isarspitz dispute amicably”.

A possible "damage minimization" would also be good for the district office in the process - "I miss that".

According to their assessment, the lower building control authority should have put a stop to the activities of the client "much earlier and more consistently".

Since the three illegal buildings were erected in Weidach, "they are in our town, so we can't just stay out of the number," says Tammelleo.

Should the worst come to the worst, there would be guaranteed nationwide television pictures of the demolition of the single-family homes.

Last but not least, that would not do much to promote the image of the rafting town.

Of course, “the incredible waste of resources” weighs more heavily for the Greens spokeswoman.

She takes the position that if the authority sticks to its "rigid stance" and continues to "just harp on paragraphs," the end result would be "destruction."

For Tammelleo, this is “not a solution to the problem”.

She appeals to the "common sense" of those involved in the process - but does not hold her protective hand over the client: "He knew what he was doing and of course he had to bleed."

In a timely manner, Tammelleo said in an interview with our newspaper, the Greens faction will “again deal with the issue of black buildings”.

She certainly has the impression that the mood in the city council is not as clear as City Hall boss Heilinglechner reported after internal discussions.

Tammelleo also sees city councilors in other factions who are interested in a debate, that is, in finding a solution.
